The subject of the contract is the delivery together with the service of transporting liquid fuel, i.e. diesel fuel to a tank at the landfill in Końskie in the amount of 240,000l.

1. The subject of the contract is the delivery together with the service of transport of liquid fuel, i.e. diesel fuel to a tank at the landfill in Końskie in the estimated amount of 240 000l. 2. The volume of a one-time delivery is approx. 5000 l of fuel at a frequency of 4 times a month. The size of the tank is 5,000 liters.

3. The place of delivery is: PGK Fuel Station in Końskie, Spacerowa 145. 4. The Contractor will be obliged to have a paid policy or other insurance document confirming that he is insured against civil liability in the scope of his business related to the subject of the contract for the duration of its implementation for the amount of not less than PLN 500,000.00 (five hundred thousand zlotys). 5. The Contractor is obliged to provide fuel of quality and parameters (composition) in accordance with the law. Diesel oil must meet the requirements of the Act of 25.08.2006 on the monitoring system

and controlling the quality of fuels (Journal of Laws of 2022, item 1315, as amended), the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (i.e. Journal of Laws of 2015, item 1680) and the parameters of the PN-EN 590+A1:2017 standard, and in the event of a change in regulations or standards, the fuel supplied will comply with the amended regulations and standards. 6. Each delivery shall be accompanied by a document concerning the quality of the fuel batch concerned, in particular specifying the physicochemical parameters (quality certificate) in the original or a certified copy.

7. The Ordering Party requires deliveries by the Contractor in a tank truck equipped with a pump or distributor, meeting all the requirements of applicable law, in particular the Act of 11 May 2001. Law on measures (Journal of Laws of 2021, item 2068) and implementing acts to the Act in the field of road tankers (vehicles for the transport of liquid fuels). The vehicle to which fuel supplies will be carried out should be equipped with a legalized measuring device measuring the amount of fuel discharge into a container service station. Both the tank and the measuring device should have important legalization features and a set of undamaged seals imposed by an authorized body. 8.The Contractor shall ensure the organization and implementation of a secure supply of fuel, the grade of which will be suitable for the season and the prevailing conditions in terms of turbidity temperature and cold filter blockage temperature. 9. The Contractor is obliged to ensure constant, successive deliveries according to the needs reported by the Ordering Party for the duration of the concluded contract. 10. Notification by the Ordering Party of the demand for current delivery with the determination of the quantity will take place by e-mail or telephone to the number provided by the Contractor. The Contractor is obliged to confirm the order in the form of an e-mail each time. 11. The Contractor is obliged to deliver fuel within 48 hours from the moment (date and time) of placing the order. The driver making the delivery must have and show documents confirming the legalization of the tank truck (tank and measuring device) - it is allowed to show potw. for the conformity with the original copies of the documents. 12. Upon receipt of fuel, the Ordering Party may check the legalization documents of the tank truck (tank and measuring device) and take a sample of fuel into a container, which will then be closed and sealed - the signatures of the Ordering Party's employee and the driver will be placed on the seal. The sample taken is the basis for pursuing possible claims for improper fuel quality. Containers for samples and seals are provided by the Contractor. 13. The receipt of fuel will be confirmed each time by the acceptance protocol / proof of delivery on the basis of the indications of the tank truck measuring device, subject to point 14. 14 In the event of a violation of the provisions of points 8 and 11, the amount of fuel delivered is determined on the basis of the indications of the measuring strip of the container service station or on the basis of the literage of the Ordering Party's measuring flask – illegal devices.
