The subject of the contract is to provide public service at the Silesian Museum in Katowice.
1. The service includes:
1) providing public service in exhibition galleries - exhibition supervisor - according to the monthly schedule of the Ordering Party;
2) cloakroom service according to the monthly schedule of the Ordering Party;
3) additional provision of audience service, cloakroom service during events organized by the Ordering Party (vernissages, finishes, concerts, Night of Museums, etc.) on the premises of the Ordering Party according to a monthly schedule. The Ordering Party shall each time commission the services to the Contractor, depending on the needs, at least 3 days in advance;
4) incidental service of the reception desk, according to the monthly schedule of the Ordering Party.
2. This order is not a contract for the physical protection of persons and property. The service of qualified physical protection of persons and property of Muzeum Śląskie in Katowice is performed by an entity holding a current concession to conduct activities in the field of personal and property protection services carried out in the form of direct physical protection and technical security, issued by the Minister of the Interior on the basis of the provisions of the Act of 22 August 1997 on the protection of persons and property (consolidated text: Journal of Laws of 2021, item 1995).
3. A detailed description of the subject of the contract (hereinafter referred to as "OPZ") is included in Annex 1 to the SWZ. In addition, the Contractor is obliged to perform the subject of the contract, in accordance with the essential provisions of the contract - Annex No. 2 to the SWZ.
4. Order completion date, order renewal.
1) The Contractor will be obliged to perform the basic contract from the date of conclusion of the contract, but not earlier than from 01.01.2024 to 31.12.2024, with the proviso that if the maximum amount of remuneration for the performance of the basic contract indicated in § 4 clause 1 point 1) of the contract is exhausted within the above-mentioned period, the contract expires without the need for additional statements by the Parties, unless the Ordering Party uses the renewal of the order;
2) The Contracting Authority reserves the right to renew this order, i.e. the obligation of the Contractor to repeat the performance of the subject of the contract once. The renewal of the order will take place the day after the completion of the performance of the basic contract, determined in accordance with the provision referred to in Chapter III, paragraph 4 point 1) of the SWZ, but not later than from 01.01.2025 to 31.12.2025. If within the above-mentioned period the maximum amount of remuneration for the performance of the renewal of the contract indicated in § 4 clause 1 point 2) of the contract is exhausted, the contract expires without the need for additional statements by the Parties;
3) the subject of the contract as part of the renewal is identical to the subject of the contract performed within the time limit specified in Chapter III, paragraph 4 point 1) of the SWZ, i.e. it will consist in performing the same works and activities as in the basic order to the extent indicated in the OPZ;
4) The Contractor shall be obliged to resume the performance of the contract only after the Contracting Authority submits a statement in this respect. The contracting authority will submit the statement no later than 14 days before the planned start of the renewal, but not later than by 16.12.2024. The statement will be submitted in writing in accordance with the rules of representation of the Ordering Party;
5) if the Ordering Party fails to submit a statement on renewal in accordance with the rules set out in Chapter III,4)(4) of the SWZ, the Contractor shall not be obliged to perform the renewal of the contract;
6) The Ordering Party reserves that the Contractor will not be entitled to remuneration in the event of resignation by the Ordering Party from the resumption of the contract, as well as no compensation in this respect.
