Conclusion of non-exclusive rebate agreements pursuant to §§ 130a para. 8/130c para. 1 SGB V for medicinal products with the active ingredient grass pollen (V01AA02) within the period from 01.03.2024 to 28.02.2026 with the possibility of concluding a contract at any time (open-house model).
In the open house procedure, medicinal products according to the BfArM list according to § 35 para. 5a SGB V (paediatric medicines) are excluded as well as marketable therapy allergens are excluded in the approval procedure according to the Therapy Allergens Ordinance (TAV).
The AOK Rhineland-Palatinate/Saarland - The health insurance fund offers discount contracts with the active ingredient grass pollen (V01AA02) to all interested pharmaceutical companies without a selection decision. The contracts are concluded within the framework of an "open house model". The contracts offered are non-exclusive; Contracts with all market participants (pharmaceutical companies) are desired by AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse. In the Open House model, uniform conditions apply to all participants. Contract contents, conditions and access procedures are uniform – individual negotiations are not conducted.
The contract periods are a maximum of 24 months, the earliest contract start date is 01.03.2024. All contracts end no later than 24 months after the date of the earliest commencement of the contract, regardless of the date on which the contract was concluded. Membership or conclusion of a contract can take place within the 24-month period on the first of each month.
There is a right of termination six weeks at the end of each month in accordance with the provisions of the contract. Further information on the termination options can be found in the contract documents.
The AOK Rhineland-Palatinate/Saarland - The health insurance fund reserves the right to replace the non-exclusive open house discount agreements with exclusive discount agreements as part of Europe-wide tender procedures during the contract period. With the entry into force of advertised, exclusive discount agreements, the open house contracts are terminated in accordance with the contractual regulation, i.e. the open house contracts end automatically.
Interested pharmaceutical companies can request the participation documents as well as the contract documents from the contact address mentioned under I.1). Contracts for the active ingredient grass pollen (V01AA02) will be concluded for the first time with effect from 01.03.2024. Interested parties who would like to become contractual partners on this date must submit the contract documents to be submitted to AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse by 31.01.2024. It depends on the access at the AOK Rheinland-Pfalz/Saarland - Die Gesundheitskasse.
Note: The first contract in this procedure will be awarded no earlier than 10 calendar days after the publication of this EU contract notice in the Official Journal. Later contracts can be concluded during the twenty-four-month maximum term for the first of each month. For interested parties who wish to become contractual partners on these subsequent dates, the receipt of the contract documents, including the attachments, must be submitted at the latest by the end of the month preceding the previous month of the desired start of the contract (e.B. receipt 30.04. at the start of the contract 01.06.). The exact deadlines for receipt will be announced with the contract documents. This publication does not concern the award of a public contract within the meaning of the Public Procurement Coordination Directive 2014/24/EU of the European Parliament and of the Council or of public procurement law. In order to ensure the greatest possible degree of transparency for the intended conclusion of contracts, they are published in the Supplement to the Official Journal of the European Union. In the absence of an appropriate publication form, the contract notice shall be used. The resulting conceptual requirements, such as the procedure designation "Open Procedure", are solely due to the use of this announcement form and the publication platform. A further significance, in particular a submission to procurement law regulations, insofar as they are not mandatory for legal reasons, is not associated with this.
