The subject of the contract are forest management services as defined in art. 6 clause 1 point 1 of the Act of 28.9.1991 on forests (consolidated text: Journal of Laws of 2017, item 788, as amended - hereinafter: "the Act on forests") covering works in the field of forest cultivation and protection , fire protection, logging and skidding of wood and tree stands, secondary use, administrative management, meadow and farming and hunting, seed and nursery to be carried out in part of the Cierpiszewo Forest District in 2019.
1) The subject of the contract is forest management services as defined in art. 6 clause 1 point 1 of the Act of 28.9.1991 on forests (consolidated text: Journal of Laws of 2017, item 788, as amended - hereinafter: "the Act on forests") covering works in the field of forest cultivation and protection , fire protection, logging and skidding of wood and tree stands, secondary use, administrative management, seed production to be carried out at the Cierpiszewo Forest District in 2019.
2) The material scope of the subject of the contract includes the sum of works in the field of forest breeding and protection, fire protection, logging and skidding of wood as well as tree stands, secondary use, administrative management, meadow farming and hunting resulting from Annex 3 to the ToR, which consists of Annex 3.1. - size of works according to activities, Annex 3.2. - difficulty zones and logging distances, Annex 3.3 - timber harvesting system, Annex 3.4 - Areas with planned protection of blooms and undergrowth, Annex 3.5 - List of species at the nursery and Annex 3.6 - List of materials provided by the Contractor.
3) A detailed description of the works (activities) included in the subject of the contract is included in Annex 3 respectively. The material ranges are listed in Annexes 3.1.-3.6. are estimates,
4) A detailed description of the technology for performing individual forest works (activities) included in the subject of the contract is included in Annex 4 to the ToR.
5) Descriptions of activity codes describing individual works (activities) included in the subject of the order are described in Annex 4 to the ToR.
6) Description of the rules for the procedure of acceptance of works is included in Annex 5 to the ToR.
7) Due to the actual natural and weather situation that may occur during the implementation of the subject of the contract, as well as the unforeseen economic and economic situation, the Purchaser reserves the right to make reducing, increasing, finding new locations, as well as suspending performing the actions indicated in the individual rows of the tables describing the subject of the contract. Increased corrections do not mean the introduction of new works not covered by the scope of the basic contract, and decreases do not mean complete abandonment of some works. They should be understood as increasing the number of works in one location, at the expense of reducing the number of works in another location - within the gross value of the subject of the contract. The corrections will apply to works carried out in the area relevant to the work included in the description of the subject of the contract related to the given lot. The need to increase the size of some elements of the contract being carried out in the course of the subject of the contract may also occur in order to implement the full scope of work described in the subject of the contract. The new location is determined as part of the subject of the contract.
8) In the case of mandatory exclusion of items from harvesting in the machine system (harvesting of wood at cutting positions where it is unacceptable to use multi-operational machines) in particularly justified cases, e.g. changes in the conditions for which the above-mentioned activities have been established, the Employer allows the change of timber harvesting technology. Justification each time must be presented to the Contractor.
