The subject of the contract is for the performance of the service entitled "Performing the function of a supervision inspector over tasks in the field of mountain retention in the Lubaczów Forest District".

The scope of performing the function of a supervision inspector takes away the supervision over the execution of project documentation, obtaining all the approvals required by law and permits necessary to obtain a building permit and commencement of construction works, as well as supervision over the implementation of construction works in the field and obtaining permission to use the retention reservoir in Opaka forestry.

The construction works will consist in forming the bottom of the tank, the slopes of the tank and the dike, and developing the remaining soil around the tank.

Basic parameters of the tank planned for implementation:

- accumulated water capacity: min. 20,700 m 3 .

- tank area: 2.3 ha + / 10%, - 5%

- average water surface depth: approx. 1.0 m, with local trims in the bottom of the tank,

- frontal dyke crown width: 2.0-3.0 m, n = 1: 2 - 1: 3,

- damming device: 1 item,

- emergency transfer: 1 item,

- existing drainage ditch (to unblock): length about 120 m.

Obligations of the contractor

1. The duties of the supervision inspector shall include in particular:

1.1. participation in the process of agreeing the project concept,

1.2. issuing opinions as to the correctness of the design solutions used by the designer, as to the applicable provisions, materials held, including the provisions of the Project Implementation Manual (Annex 6 to the ToR),

1.3. checking the completeness of the materials received,

1.4. full scope of obligations specified in art. 25 of the Construction Law of July 7, 1994 (Journal of Laws of 2019, item 1186, as amended) and implementing regulations,

1.5. having thorough knowledge of project documentation and the content of the contract concluded by the contracting authority with the contractor of construction works, as well as by the contractor with a subcontractor,

1.6. regular monitoring of the timeliness and compliance of construction works by the contractor and subcontractors with the material and financial schedule,

1.7. exercising control of works on an ongoing basis in terms of compliance of their execution with the design and technical documentation, technical specifications for the execution and acceptance of works, building permit, building standards and building law as well as the principles of technical knowledge,

1.8. as part of the rights arising from the construction law - making decisions about carrying out construction works or suspending their acceptance of works after the contractor declares readiness for acceptance,

1.9. caring for the interests of the contracting authority, in particular in the event of their conduct being found contrary to the contract and occupational health and safety regulations,

1.10. undertaking activities ensuring technical correctness of the implemented investment,

1.11. making decisions and taking responsibility for decisions taken, in matters related to the quality of works, assessment of the quality of construction products within the meaning of art. 10 of the Construction Law and the progress of works, as well as providing explanations in matters related to design documentation and technical specifications for the execution and acceptance of works, excluding matters affecting the increase in construction costs,

1.12. organizing the work related to supervision in a way that does not cause an unjustified interruption in the implementation of the works by the contractor or subcontractor,

1.13. controlling the quality of used construction products within the meaning of art. 10 of the Construction Law, requesting additional qualitative tests of construction products in situations provided for by law, and mandatory checking of certificates and declarations of compliance of materials provided by the contractor before their incorporation.

The remaining obligations of the contractor relate to all partial tasks and are described in point II.2.4 in part 2.

- a band ditch that is about 15 m long.

Obligations of the contractor

Continued - The duties of the supervision inspector will include in particular:

1.14. a request for the contractor to remove defects revealed in the course of works and defects in performed works, and to inform the contracting authority if these defects are not removed,

1.15. accepting disappearing works and those which are subject to cover within the time limits specified in the contract for the performance of construction works,

1.16. participation in the activities of partial acceptance and final acceptance, and as part of these activities confirming readiness for acceptance, forwarding the acceptance protocols to the contracting authority and as-built documentation, confirming the works actually carried out and removing any defects,

1.17. confirmation of the work performed as the basis for the invoice to be drawn up by the contractor and payment of his remuneration,

1.18. immediately signaling the contracting authority of all circumstances that may affect the timeliness and correctness of construction works performed and the occurrence of circumstances not provided for in the design documentation,

1.19. participation in the transfer of tasks to the contractor of the construction site and participation in meetings organized by the contracting authority in matters related to the implementation of the investment in question,

1.20. obtaining explanations from the designer regarding the project and the solutions it contains,

1.21. recognizing and presenting to the contracting authority the scope of additional or replacement works proposed by the contractor,

1.22. checking the performed works, notifying the contractor about the detected defects and certifying the removal of defects by the contractor, as well as determining the type and scope of correction works necessary to perform,

1.23. confirmation of the date of completion of works,

1.24. controlling the security by the contractor of the construction site in the event of withdrawal from the contract by either party,

1.25. settlement of the contract in the event of withdrawal from the contract by either party,

1.26. controlling the contractor's compliance with occupational health and safety and environmental protection regulations,

1.27. participation in carrying out trials, measurements and checks carried out in connection with the implemented investment,

1.28. coordinating works in individual industries,

1.29. controlling the correctness of keeping the construction log by the contractor of construction works and making entries in it regarding all circumstances relevant to the conduct of the proper construction process,

1.30. preparing and settling all formal and legal matters related to carrying out and completing works, as well as solving all other problems arising during the implementation of the investment.
