The subject of the order is the gradual delivery of office supplies listed in the Assortment and Price Form, constituting Annex 6 to the ToR (hereinafter referred to as the Assortment and Price Form) to each of the Units listed in Annex 1 to the ToR.

The detailed manner of implementation of the subject of the contract is specified in Annex 2 to the ToR - Material provisions of the contract. Whenever the description of the subject of the contract indicates the trademarks, names of producers and distributors, it always allows the contractor to offer equivalent products within the meaning of the Public Procurement Law, with technical, quality or functional characteristics of the same or similar to those which contain the scope of equivalence indicated in the description of the subject of the contract.

All offered articles must be brand new, free from physical and legal defects and claims of third parties, they must not bear signs of use and must be wholesome in the first grade, i.e. without deformation, not mechanically damaged, complete, and generally available on the market. Articles must be packaged by the manufacturer and have product identification marks. The Employer allows for self-assembly by the Contractor if the Unit, during the performance of the contract, orders quantities other than the manufacturer's collective packaging.

In the items of the Assortment and Price Form, in which the Employer indicated the possibility of delivering the subject of the order in various colors, sizes, the Contractor is obliged to deliver in accordance with the individual needs of the Units, determined each time when ordering a given Unit. The indicated different colors and sizes should be understood as the colors and sizes available on the market from a given manufacturer indicated by the Contractor in individual items of the Assortment and Price Form.

The articles offered by the Contractor must be admitted to trading in the European Union and meet the requirements specified in the provisions and standards in force during the contract period, in particular in:

The Act of 25.2.2011 on chemical substances and their mixtures (Journal of Laws of 2018, item 143 as amended);

Regulation of the Minister of Family, Labor and Social Policy of 12.6.2018 on the highest permitted concentrations and intensities of factors harmful to health in the work environment (Journal of Laws of 2018, item 1286);

Ordinance of the Minister of Culture and National Heritage of October 20, 2015

On the classification and qualification of documentation, transfer of archival materials to state archives and the lack of non-archival documentation

(Journal of Laws 2015, item 1743, as amended) - applies to archiving articles listed in item No. 327, 330, 335, 336, 410, 415, 416, 417, 418, 419.

The Employer requires that the Contractor, to whom the contract is awarded, provide the Units, for the duration of the contract, with a fully functional online customer service system - an online platform through which each Unit covered by the joint order will make orders for office supplies that are the subject of the contract. The internet system must meet the requirements described in Annex 4 to the Essential Provisions of the Agreement.

The contractor is obliged to provide a team of people dedicated to support the Units in the scope of the implementation of the subject of the contract. One person may be responsible for cooperation with up to five Units. Prior to concluding the contract, the Contractor shall provide a list of persons assigned to operate individual Units.
