Delivery of 10 brand new eco-friendly, low-floor city buses for PKM Katowice Sp. z o.o.

Delivery of 10 brand new eco-friendly, low-floor city buses for PKM Katowice Sp. z o.o. with a length of up to 18.75 m and powered by diesel fuel. A detailed description of the subject matter of the contract is included in the Terms of Reference.

Delivery of 10 brand new eco-friendly, low-floor city buses for PKM Katowice Sp. z o.o. meeting the requirements set out in points III.6 and III.7. SWZ.

The Ordering Party requires that the delivered vehicles meet at least the requirements and conditions set out in the following standards and regulations:

1. The bus must meet all the requirements set out in Section III of the Act of 20 June 1997 - Road Traffic Law (consolidated text: Journal of Laws of 2023, item 1047, as amended) and meet the technical conditions specified in the Regulation of the Minister of Infrastructure of 31 December 2002 on the technical conditions of vehicles and the scope of their necessary equipment (consolidated text: Journal of Law of 2016, item 2022, as amended. amended).

2. The offered bus must have a valid "Vehicle Type Approval Certificate" with attachments confirming the unconditional granting of homologation, issued in accordance with the applicable regulations, in particular on the basis of the Act of 20 June 1997. Road Traffic Law (consolidated text: Journal of Laws of 2023, item 1047, as amended) and the Regulation of the Minister of Infrastructure of 2 August 2023 on vehicle type approval (Journal of Laws of 2023, item 1651).

3. The offered bus must meet the requirements of Regulation (EU) 2019/2144 of the European Parliament and of the Council of 27 November 2019 on type-approval requirements for motor vehicles and their trailers and systems, components and separate technical units intended for such vehicles, with regard to their general safety and the protection of persons in the vehicle and vulnerable road users, amending Regulation (EU) 2018/858 of the European Parliament and of the Council and repealing Regulations (EC) No 78/2009, (EC) No 79/2009 and (EC) No 661/2009 of the European Parliament and of the Council and Commission Regulations (EC) No 631/2009, (EU) No 406/2010, (EU) No 672/2010, (EU) No 1003/2010, (EU) No 1005/2010, (EU) No 1008/2010, (EU) No 1009/2010, (EU) No 19/2011, (EU) No 109/2011, (EU) No 458/2011, (EU) No 65/2012, (EU) No 130/2012, (EU) No 347/2012, (EU) No 351/2012, (EU) No 1230/2012 and (EU) 2015/166 (OJ L 2019 No 325, p. 1, as amended);

4. The offered bus must meet the homologation confirming the condition of non-flammability of the equipment of the passenger compartment and the driver's cabin on the basis of the Regulations of 21 April 2015. No 118 of the United Nations Economic Commission for Europe (UNECE) – Uniform technical regulations concerning the flammability of materials used in the construction of certain categories of motor vehicles and their resistance to fuels or lubricants [2015/622] (OJ L 2015 No. 102, p. 67, as amended).

5. In a situation where, in the period between the submission of the offer by the Contractor in the procurement procedure and the performance of the contract, there is a change in the provisions of law regarding the registration, approval, sale or introduction into service of new buses (as well as assemblies and subassemblies for these buses), the Contractor is obliged to perform the subject matter of the contract taking into account these changes. In particular, this obligation applies to the delivery to the Contracting Authority of buses that meet the requirements set out in accordance with the above-mentioned regulations, as well as documents enabling the registration of these buses in the Republic of Poland.

6.The contracting authority shall require that the share of goods originating in the Member States of the European Union or countries with which the European Community has concluded agreements on equal treatment of entrepreneurs exceeds 50% in the supply in question. The Contracting Authority will reject an offer that does not meet this requirement.
