The focus of the order is on the direct placement of workers as employees: inside at gematik.
It is the typical activity of a recruiting service provider / headhunter.
For this purpose, a framework agreement must be concluded with the contractors (intermediaries), which forms the basis for the conclusion and implementation of individual calls to (partially) cover gematik's personnel requirements.
We are looking for specialists in the following areas:

For the areas mentioned in the service description (Annex 1 to the framework agreement), gematik intends to conclude a framework agreement for direct personnel placement with an unlimited number of interested contractors (intermediaries) until any exclusive contracts come into force following a public tender.
The subject of the procurement needs are direct recruitment services in the following service categories according to the service description on which this procedure is based:
- Software developer: in,
- Software developer: in mobile platforms,
- test specialists,
- Test manager: in,
- Test architect: in,
- Solution Architect: in,
- IT architect: in,
- Transition Manager: in,
- Application specialist: in,
- Service Delivery Manager: in,

The interested party must commit to at least one of the above-mentioned service categories. In addition, it is possible to commit to several or all of the above-mentioned service categories without restriction.
For the above-mentioned areas, gematik intends to conclude a framework agreement for direct personnel placement with an unlimited number of interested contractors (intermediaries). The framework agreement forms the basis for the conclusion and execution of individual contracts (individual call-offs) between the client and the contractor for direct personnel placement services.

Note: Publication is done here using the open procedure form. However, it is not such an open procedure – the notice form had to be used for technical reasons, as there is no form suitable for admission procedures. Rather, gematik assumes that this approval procedure does not fall within the scope of "antitrust procurement law" due to a lack of a selection decision and thus the non-discriminatory possibility of access to the framework agreement.
The framework agreement as part of the approval procedure will enter into force for the first time on 15.3.2021 and will end on 31.3.2023, subject to the contractual extension option. In the contract in accordance with clause 8.2 Extension Option, the term of this contract may be extended 1 (once) time by 2 (two) years. The client has made use of this option. The new end of the framework agreement is 31.03.2025. Irrespective of this, the contract ends automatically with the entry into force of any exclusive contract for direct personnel placement services as a result of a formal award procedure in accordance with the provisions of Part 4 of the GWB with one or more contractual partners.
The prerequisite for the conclusion or subsequent accession to the framework agreement, which will come into force for the first time on 15.3.2021, is the complete and timely sending of the following proofs/declarations/attachments to the contact person listed below at gematik:
1. Application for admission or accession to the framework contract, Direct Recruitment – Open House" (form),
2. Evidence of entry in the professional or commercial register (not older than 6 months at the time of the application for admission or membership) in accordance with the legal provisions of the country in which the company is based (in an unauthenticated copy) or, if applicable , Declaration that there are no entries in the professional or commercial register in accordance with the respective state legislation (form),
3. Self-declaration of the company regarding reliability (form),
4. self-declaration that the company has fulfilled its obligations to pay taxes, duties or social security contributions (form),
5. Framework agreement "Direct Personnel Placement - Open House".
