Purchase of electricity with the total volume of the basic order: 1 493 437 kWh and with a total volume resulting from the right of option 300 395 kWh, which constitutes the supply (sale) of electricity to the following pickup points:

1) under Part 1 of the order with a volume for the basic contract not exceeding 1,143 875 kWh — up to 156 receiving points (measuring) listed in the list of electricity collection points of the Mykszków Municipality, which is annex 1 to the SWZ, and with a total volume resulting from the right option: 300 395 kWh;

2) under Part 2 of the order with a volume not exceeding 349 562 kWh — up to 36 receiving (measurement) points listed in the list of electricity collection points of the facilities of organizational units of the Municipality of Myszków, which is annex 2 to the SWZ.

1) The Contracting Authority, in the framework of the proceedings for the award of a public contract aimed at selecting an offer and concluding a contract for part 1 of the contract, acts on behalf of the Myszków Municipality and for the benefit of the Municipality of Myszków;

2) The estimated electricity demand for the period from 01.05.2022 to 30.04/2023 for electricity collection points referred to in Annex 1 to the SWZ shall be: 1 143 875 kWh, including:

(a) in tariff group O11 — 995 325 kWh,

(b) in tariff group C12B — 11 131 kWh, including:

• Day — 3 380 kWh,

• Night — 7 751 kWh,

(c) in tariff group C11 — 212 kWh,

(d) in tariff group C21 — 137 171 kWh,

(e) in tariff group R — 36 kWh;

3) The Contracting Authority has concluded indefinite contracts for the provision of electricity distribution services:

(a) from Tauron Distribution S.A., Branch in Częstochowa, Army Krajowa Al 5, 42-201 Częstochowa — in tariff groups: O11, C11, C21, R,

b) from Tauron Distribution S.A., Branch in Będzin, 141 Małobądzka Street, 42-500 Będzin — in tariff group C12B,

and the concluded agreement for the sale of electricity with ELEKTRA S.A.with its registered office in Warsaw (01-230) Skierniewicka 10a, which is valid until 03.03.2022.

4) The Contractor is obliged on the basis of the power of attorney - Annex No 10 to the SWZ, which will be granted by the Municipality of Myszków, to notify the above-mentioned Distribution System Operators (DSO) for the implementation of the concluded new contract for the sale of electricity to the consignee connected to the network the distribution of Tauron Distribution S.A. and carry out the procedure related to the change of the seller of electricity;

5) Guaranteed minimum order range to be completed, constituting the basic order, is: 1 143,875 kWh, including:

(a) in tariff group O11 — 995 325 kWh,

(b) in tariff group C12B — 11 131 kWh, including:

• Day — 3 380 kWh,

• Night — 7 751 kWh,

(c) in tariff group C11 — 212 kWh,

(d) in tariff group C21 — 137 171 kWh,

(e) in tariff group R — 36 kWh;

6) The Ordering Party stipulates that optionally, depending on their own choice, may increase the minimum range of delivery by 300 395 kWh including:

(a) in tariff group O11 — 278 135 kWh,

(b) in tariff group C12B — 1 670 kWh, including:

• Day — 507 kWh,

• Night — 1 163 kWh,

(c) in tariff group C11 — 14 kWh,

(d) in tariff group C21 — 20 576 kWh;

7) Maximum order range, including option law, is 1,444,270 kWh, including:

(a) in tariff group O11 — 1 273 460 kWh,

(b) in tariff group C12b — 12 801 kWh, including:

• Day — 3 887 kWh,

• Night — 8 914 kWh,

(c) in tariff group C11 — 226 kWh,

(d) in tariff group C21 — 157 747 kWh,

(e) in tariff group R — 36 kWh;

1) The Contracting Authority, in the framework of the proceedings for the award of a public contract aimed at selecting an offer and concluding a contract for Part 2 of the contract, acts on behalf of and for the benefit of the following organisational units of the Municipality of

(a) Adam Mickiewicz Primary School No. 1, 42-300 Myszków, Leśna Street 1,

b) John Paul II Primary School No. 2, 42-300 Myszków, 34 Jaworznicka Street,

c) Tadeusz Kościuszko Public School Complex No. 3, 42-300 Myszków, Kosciuszki Street 30,

d) Elementary School with Integrative Branches No. 5 named after Henryk Sienkiewicz, 42-300 Myszków, Sikorskiego Street 20a,

e) Primary School No. 6, 42-300 Myszków, Wapienna Street 2,

f) Jan Brzechwa Primary School No. 7, 42-300 Myszków, Pińczycka Street 2,

g) Kindergarten No. 1 “FAIRYTALE”, 42-300 Myszków, 32 Sucharskiego Street,

h) Kindergarten No. 2, 42-300 Myszków, Pułaskiego Street 7A,

j) Kindergarten No. 3 with Integration Branches, 42-300 Myszków, 19Millenium Street,

k) Kindergarten No. 4, 42-300 Myszków, Skłodowska Street 7,

l) Maria Konopnicka Kindergarten No. 5, 42-300 Myszków, Stalowa Street 1,

m) Municipal Department of Housing Management, 42-300 Myszków, 26 Kościuszki Street;

2) The estimated electricity demand for the period from 01.07.2022 to 30/04/2023 for pickup points referred to in Annex 2 to the SWZ shall be: 349 562 kWh, including:

(a) in tariff group C11 — 155 124 kWh,

(b) in tariff group C21 — 124 882 kWh,

(c) in tariff group C22B — 58 796 kWh, including:

• Day — 42 676 kWh,

• Night — 16 120 kWh,

(d) in tariff group G11 to 10 760 kWh;

3) The above-mentioned organizational units of the Myszków Municipality have concluded for an indefinite period of contract for the provision of electricity distribution services with Tauron Distribution S.A. Branch in Częstochowa and concluded agreement for sale of electricity with the seller E.ON Polska, Wybrzeże Street Kościuszkowskie 41, 00-347 Warsaw, which is in force until 30.06.2022;

4) The Contractor is obliged on the basis of the power of attorney — Annex No 12 to the SWZ, which will be granted by the municipality of Myszków to notify the Distribution System Operator (OSD): Tauron Distribution S.A., Branch in Częstochowa for the implementation of the new contract for the sale of electricity for customers connected to the distribution network of Tauron Distribution S.A., and to carry out the procedure related to the change of the electricity seller;

5) The Ordering Party for Part 2 of the order does not provide for exercising the right option when purchasing electricity.

6) Detailed regulations concerning the performance by the Contractor of the sale of electricity to the organizational units of the Municipality of Myszków are described in the proposed provisions of the contract on public procurement - part 2 of the contract, which is annex 11 to the SWZ
