The scope of the subject of the contract includes in particular:
mowing grasses, weeds and annual self-sowing,
cutting down bushes and self-sowing of medium density with export,
cutting or pruning branches, care treatments including export,
mechanical felling of trees with grubbing and milling of trunks with export,
planting trees over 10 years old with a circumference of 14-16 cm together with dressing and care of planted trees in order to preserve their vitality for a period of at least three years from the date of planting,
other works and works necessary for the proper performance of the subject of the contract.
4.1 The scope of the contract includes in particular:
4.1.1 mowing grasses, weeds and annual self-seeding,
4.1.2 cutting down of shrubs and self-seeding of medium density with export,
4.1.3 cutting or pruning branches, care operations including export,
4.1.4 mechanical felling of trees with grubbing-up and milling of trunks with export,
4.1.5 planting of trees over 10 years old with a circumference of 14 to 16 cm, including dressing and care of planted trees in order to preserve their viability for a period of at least three years from the date of planting,
4.1.6 other works and works necessary for the proper performance of the subject of the contract, including but not limited to:
▪ marking and securing the work area,
▪ development of a traffic organization project for the duration of work (if required),
▪ organization of facilities,
▪ organization of walks and commutes to the property during the work,
▪ current export of unusable materials,
▪ performing repair works of technical infrastructure, the technical condition of which has deteriorated as a result of the execution of works, including restoration works.
4.2 A detailed description and scope of the subject of the contract is specified in the technical specification.
4.3 The Contractor is obliged to perform the contract on the terms and conditions specified in the model contract.
4.4 The Purchaser shall not divide the order into lots.
4.4.1 Dividing the contract into lots would not increase the involvement of SME Contractors, nor would it increase competitiveness in the procedure.
4.5 Pursuant to Article 95(1) of the PPL, the Contracting Authority requires the contractor or subcontractor to employ persons under an employment contract to perform the activities indicated by the Contracting Authority in the scope of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2022, item 1510, as amended), i.e. the activities of the operator of grass mowing equipment, weeds and annual self-sowing, cutting and grubbing up bushes, mechanical felling of trees with grubbing up and milling of trunks, tree planting operations including dressing, operations for the care of planted trees in order to preserve their viability for at least three years from the date of planting.
4.12 One of the evaluation criteria is the deadline for the execution of a partial order. The maximum deadline for the execution of a partial order that may be declared by the contractor is up to 20 business days from the date of receipt of the order. Bids of a contractor who does not declare in the bid the deadline for the execution of a partial order or declares the deadline for the execution of a partial order longer than up to 20 business days from the date of receipt of the partial order will be rejected pursuant to Article 226(1)(5) of the PPL.
