1. The subject of the order is the purchase of a front electric forklift along with delivery to the Ordering Party's headquarters. The exact description of the subject of the order is set out in the Annex to SWZ — “Detailed description of the subject of the order” - Annex No 8 to SWZ.

The undertaking is implemented as part of the project “Expansion of the Jarocin Waste Zoning Plant — Wielkopolskie Recycling Centre” - the agreement for funding no POIS.02.02.00-00-0004/19-00 under action 2.2. Municipal Waste Management Priority Axis II Environmental Protection, including adaptation to climate change of the Infrastructure and Environment Operational Programme 2014-2020.

7. The Contractor is obliged to use only factory new materials with valid relevant required certificates for the execution of the subject of the contract
and certificates and admissions confirming the possibility of applying them to the performance of this contract.
8. In accordance with Article 101 (4) of the PZP, the Contracting Authority shall allow solutions equivalent to those described in the SWZ by means of standards, technical assessments, technical specifications
and the technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the PZP, if they allow to obtain characteristics or parameters no worse than those cited.
9. In accordance with Article 101 (5) of the PZP, the Contractor who invokes the equivalent solutions described by the Contracting Authority is obliged to prove in the offer that the proposed solutions satisfy the requirements set out in the description of the subject matter of the contract.
10. Whenever the SWZ indicates a trademark of material, patent or origin, source or specific process that characterizes the products or services provided by a particular contractor, the Contractor may use indicated or equivalent other material that meets the technical requirements indicated by The Ordering Party. Whenever this specification describes the subject of the contract by means of standards, approvals, technical specifications and reference systems, the Contracting Authority shall allow solutions equivalent to the described ones. The Contractor who invokes the equivalent solutions described by the Ordering Party shall demonstrate that the works offered by him meet the requirements set out by the Contracting Authority. Equivalent solutions shall be understood to guarantee parameters not worse than specified in SWZ. The Contractor who invokes the equivalent solutions described by the Contracting Authority shall demonstrate that the works or materials offered by him meet the requirements set out by the Contracting Authority. Acceptance of equivalent materials on the part of the Contracting Authority will be in writing on the basis of documents submitted by the Contractor (catalogue cards or other documents) proving their equivalence.
