Restricted tendering procedure to be awarded on the basis of the criterion of the most economically advantageous tender. The works in question are part of the broader infrastructural completion of the port of Termini Imerese - "New quay for the logistics of the port of Termini Imerese" (CUP Master I61B21002290005) - referred to in the intervention sub. " Intermodal logistics platform - Reinforcement of the container terminal (CUP I67F21000010006).

At present, the preliminary verification of the design is being carried out. The completion of the tender procedure is therefore conditional on the conclusion of the verification and the PSA will proceed with the transmission of the invitation letter only after verification and validation of the executive project, as it is the project on the basis of the tender on which the participants are invited to formulate the bid.

The intervention "PNRR ZES - PORT OF TERMINI IMERESE. COMPLETION OF TERMINI IMERESE INFRASTRUCTURE – NEW LOGISTICS QUAY – CUP Master: I61B21002290005" is included in the Infrastructure Intervention Program for Special Economic Zones (SEZs) of the National Recovery and Resilience Plan (PNRR), approved by Interministerial Decree no. 492 of 03/12/2021, for the amount of € 36,000,000.00; the latter is in turn divided into 3 sub-interventions including the project called "Port of Termini Imerese - Intermodal Logistics Platform - Reinforcement of container terminals", CUP connected I67F21000010006. Following the acceptance of the funding granted by the Ministry of Sustainable Infrastructure and Mobility in agreement with the Ministry for the South and Territorial Cohesion, on 21/10/2022 the relevant Deed of Obligation was signed, approved by Directorial Decree no. 263 of 10/11/2022 and duly registered by the Court of Auditors.

In relation to the award procedure, even under the new Code of Public Contracts and Concessions (Legislative Decree 36/2023), since this is an intervention to be carried out under the PNRR, the provisions of Decree-Law 77/2021 so-called Simplification Decree Bis, converted with amendment by Law 108/2021, which introduced special provisions on Governance for the PNRR and further provisions on acceleration and streamlining, continue to apply administrative procedures.

For the assignment of the works, taking into account the timing of the funding obtained and the timing of implementation, a restricted procedure is carried out pursuant to art. 61 of Legislative Decree no. 50/2016, therefore, any economic operator may submit an application to participate in response to this call for tenders, providing the information necessary for the purposes of qualification. In any case, only economic operators invited by the contracting authority may submit a tender. The contracting authority avails itself of the right to reduce the deadlines, provided for by art. 61, paragraph 6 of Legislative Decree 50/2016 and the simplification decrees, motivated by reasons of urgency related to the loss of the funded, considering that the delivery of the works must take place by 31.12.2023.

The object of the contract is the construction and installation works aimed at strengthening the container terminal (main contract). The initial project also includes the construction of an industrial warehouse that the administration may entrust - pursuant to art. 63, par. 5, of Legislative Decree 50/2016 - to the same economic operator, through a negotiated procedure, as complementary works. The use of this procedure is limited to the three years following the conclusion of the initial contract. In determining the total amount of the contract, estimated at € 1,800,000.00, it was taken into account - pursuant to art. 35 of Legislative Decree 50/2016 - the value of the main contract (equal to € 1,000,000.00 of which € 40,000.00 for security charges not subject to reduction) and the amount of the complementary works (equal to € 800,000.00 of which € 40,000.00 for security charges not subject to reduction)
