The subject of the contract is the Supply (sale) of electricity for the purposes of street lighting and traffic lights in the city and municipality of Wieliczka in 2024.

The contracting authority plans to purchase a total of approximately 4,705,000 kWh in 2024, of which the tariff includes:
a) active daily energy C12b – 2 016 000 kWh,
b) active night energy C12b – 2 619 000 kWh,
c) C11 energy – 70 000 kWh,
Number of collection points: 295 pcs. The collection points are located in the area of OSD-TAURON Dystrybucja Spółka Akcyjna 31-538 Kraków, 11 Jasnogórska Street. The control of road lighting is carried out by means of dusk sensors and astronomical clocks.

The Contractor who wins the tender undertakes to submit, on behalf of the contracting authority, to the Distribution System Operator competent for the Contracting Entity, a notification on the conclusion of a contract for the sale of electricity. The currently applicable distribution agreements are concluded for a definite period, i.e. until 31.12.2023. The Ordering Party shall grant an appropriate power of attorney to the Contractor in order to conclude contracts for the provision of distribution services in time to effectively carry out the procedure of changing the seller.
The Contracting Authority shall provide the Contractor with all necessary data to carry out the change of the seller for each point of consumption, as well as provide the Contractor with an appropriate power of attorney to submit on behalf of the Ordering Party the concluded contract for the sale of electricity to the DSO and to perform the activities necessary to carry out the process of changing the seller at the DSO. The content of the relevant power of attorney shall be specified by the Ordering Party.

The Ordering Party informs that separate contracts for the sale and distribution of electricity are currently in force. They are concluded for a period of one year and their validity expires on 31.12.2023. The current electricity seller is: Tauron Sprzedaż Kraków, the agreement is valid until 31.12.2023.
Electricity will be supplied under the conditions specified in the Act of 10 April 1997 - Energy Law (i.e. Journal of Laws of 2022, item 1385, as amended), executive regulations to this Act, and in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (i.e. Journal of Laws of 2007 No. 93, item 623, as amended), Tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Distribution Network Operation and Operation Manual (IriESD) and generally applicable legal regulations. The Contractor is obliged to sell electricity in compliance with applicable quality standards, i.e. to provide the Contracting Authority with quality standards of service in accordance with the applicable provisions of the Energy Law.
If a trademark, patent or wording indicating the origin, source or specific process that characterizes the subject of the contract has been used to describe the subject of the contract contained in the contract notice, tender specifications and annexes to the tender specifications, the Contracting Authority shall indicate that it allows the use of solutions equivalent to those described. The Contractor who refers to solutions equivalent to those described by the Contracting Authority is obliged to demonstrate that the equivalent solutions offered by it meet the requirements specified by the Contracting Entity.
To nin. Article 5k of Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, as amended by COUNCIL REGULATION (EU) 2022/576 of 8 April 2022, shall apply.
