1. The subject of the contract is the supply of vegetables and fruits to the Police School in Katowice for a period of 6 months.
2. Detailed description of the subject of the contract: The full list of the assortment being the subject of delivery and the maximum quantity of ordered products is given in the assortment-quantity-value specification constituting Annex 1A to the SWZ.
3. The Ordering Party reserves the option of not fulfilling the subject of the contract worth up to 50% of the total gross remuneration. No financial or legal claims are entitled to the Contractor's part of the contract.
4. Delivery, unloading and contributing will be made at the Contractor's expense calculated in the price of the products covered by the contract

1. The subject of the contract are deliveries of vegetables and fruits to the Police School in Katowice for a period of 6 months.
2. The full list of the assortment in supply and the maximum quantity of products processed is given in the assortment and quantitative value specification set out in Annex 1A to SWZ.
3. The quantities provided are estimates and do not oblige the Ordering Party to purchase products in those quantities.
4. Proposing products inconsistent with the requirements of the Contracting Authority shall be tantamount to rejecting the Contractor's offer pursuant to Article 226(1)(5) of the PPL Act – as inconsistent with the terms of the contract.
5. For the assortment specified in Annex 6 to the SWZ, the Contracting Authority shall determine the price coefficient (in accordance with Chapter XVII of this SWZ) based on stock exchange quotations observed in 2022 on the Warsaw Agricultural and Food Wholesale Market in Bronisze, on the basis of which settlements will be made. 6. The offered unit price of the articles listed in the Assortment-Quantity-Value Specification constituting Annex 1A to the SWZ, under pain of rejection of the Contractor's offer pursuant to Article 226(1)(5) of the PPL Act – as inconsistent with the terms of the contract, may not be higher than the prices indicated in Annex 6 to the SWZ.
7. The Ordering Party reserves the right not to perform the subject of the contract with a value of up to 50% of the total gross remuneration. For non-performance of part of the contract, the Contractor is not entitled to any financial or legal claims.
8. Delivery, unloading and bringing in the subject of the contract shall be carried out at the expense of the Contractor included in the price of products covered by the public procurement contract.
9. Delivery of the subject of the order shall be performed by means of transport of the Contractor permitted for the carriage of food.
10. Persons performing the delivery must have a current medical certificate for sanitary and epidemiological purposes, which they present at the request of the Ordering Party.
11. The Contractor is obliged to have a current certificate of entry in the register of establishments subject to official control of the competent authorities - in accordance with the Act of 25 August 2006 on food and nutrition safety (i.e. Journal of Laws of 2022, item 2132,
of late. Deaths). The developer must be subject to constant supervision by the competent authorities.
12. The offered products must meet the requirements set out in the applicable law on the production and marketing of food. Each product must be manufactured and placed on the market in accordance with the requirements of the HACCP system.
13. Details of the delivery are set out in the model contract constituting Annex 5 to the SWZ.
14. The Contractor shall ensure the protection of the transferred personal data in accordance with the Act of 10 May 2018 on the protection of personal data (i.e. Journal of Laws of 2019, item 1781) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR) (i.e. Journal of Laws of 2019, item 1781). UE L 2016, no. 119, p. 1). The obligation to inform Subcontractors, third parties and consortium members about the processing of personal data rests with the Contractor. The Contractor's statement on the fulfillment of the obligations arising from art. 13 or art. 14 of the GDPR towards natural persons from whom personal data has directly or indirectly obtained in order to apply for this contract will be submitted in the offer form - constituting Annex 1 to the SWZ.
