Procedure opened concerning the measurement of the workload of magistrates and clerks on behalf of the FPS Justice

As part of the development of an allocation model for courts and tribunals, the College of Courts and Tribunals wishes to determine the number of magistrates and FTE registrars needed for legal work or product-related activities within courts and tribunals. For this, the College of Courts and Tribunals needs in the second half of 2023 the national average processing time of a series of types of court cases.

To make this calculation, the College also wants to know how many hours judges and registrars (broken down by type of entity/section) actually work on average in 2023 and how much of this time is devoted to non-case activities (study, work consultation, etc.).

The College of Courts and Tribunals needs an in-depth correction and a complement to a measurement of the workload carried out internally previously.

In particular, it is now necessary to consider:

- the average number of hours of work per week of a judge/registrar, with a record of the work done in individual cases, on the one hand, and work not related to files (such as training, meetings, committee work, management tasks, etc.), on the other hand;

- the relationship between the two types of timetable (work related to files and work not related to files), broken down by type of entity;

- the average processing time by type of case and by type of court, bearing in mind that there are 47 distinct types of court cases for 7 types of courts.

The results of this survey will be used from 2024 and beyond:

- in order to formulate the number of judges in nominal values at national level, and

- in order to be able to determine the number of judges by type of court.

The distribution within the same type of jurisdiction will be based on the proportions as they result on the basis of products and time estimates according to the internal workload measure.

The results of this survey are expected in the second half of 2023.

That is why the College is launching this European call for tenders.
