The subject of the contract is: the provision of a comprehensive service consisting in the supply / sale of electricity together with the electricity distribution service for the needs of SPZOZ Międzychód within the meaning of the Act of 10 April 1997 – Energy Law – in the planned total amount of about 800 MWh over a period of 12 months.

2. The subject of the contract is the sale of electricity together with the electricity distribution service for the needs of the Ordering Party. A detailed description of the subject of the contract, including the names and locations of the facilities, the forecasted demand for electricity during the term of the contract, types of tariffs, contractual capacity, place of delivery and the necessary data for the conclusion of the contract is included in Annex 3.

3. The values indicated in Annex 3 are estimates, which does not reflect the actual or declared use of electricity during the term of the contract and in no case can be the basis for any claims on the part of the Contractor. Actual settlements will take place on the basis of current indications of metering and settlement systems for the supply of electricity in accordance with the Contractor's offer, for the distribution of electricity will take place on the basis of fees resulting from the Tariff of the Distribution System Operator.

4. The supply of electricity and the provision of distribution services will take place under the conditions specified in the Energy Law of 10 April 1997 (Journal of Laws of 2012, item 1059, as amended) implementing regulations to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on special conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623), tariff for electricity distribution services of the relevant Distribution System Operator (DSO Tariff), Instructions for Operation and Operation of the Distribution Network (IRiESD) and generally applicable legal regulations.

5. The Contractor is obliged to have, as at the date of commencement of the provision of the comprehensive service, an agreement with the Distribution System Operator, to whose network the Ordering Party's facilities are connected, enabling the provision of a comprehensive service for the facilities covered by this contract.

6. The Contractor must have a concession to conduct business activity in the field of electricity distribution issued by the President of the Energy Regulatory Office. If the contractor is not the owner of the distribution network, it must have a signed contract with the Distribution System Operator (DSO) for the provision of electricity distribution services by the DSO.

7. The offer must be submitted for a comprehensive service.

The complete offer consists of a sales offer and an offer for the sum of fixed and variable costs in the field of electricity distribution.
