Comprehensive supply of electricity in the years 2023-2024 for the needs of the purchasing group of the Sokołów Małopolski Commune in the amount of 6352 MWh.
1. The subject of the contract is a comprehensive supply of electricity for the years 2023-2024, including the sale of electricity and the provision of electricity distribution services for the needs of the sokołów Małopolski Commune purchasing group.
2. The estimated electricity consumption during the term of the contract shall be 6352 MWh.
The place of supply of electricity are the points of consumption listed in Annex 1 to the SWZ.
3.The sale of electricity will take place. under the conditions laid down in the provisions of the Act of 10 April 1997. Energy Law (Journal of Laws of 2021, item 716, as amended) implementing regulations to this Act, in particular the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the functioning of the power system (Journal of Laws of 2007 No. 93, item 623, as amended), the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in electricity trading (Journal of Laws of the Republic of Poland). U. of 2019, item 503 of late. as amended) with the principles set out in the concessions, the provisions of the SWZ and the price of electricity presented in the offer and with the prices of distribution parameters consistent with the current tariffs of the distribution network operator, approved by the President of the Energy Regulatory Office with which the Contractor has concluded a contract for the provision of distribution services.
4.Due to the nature of the contract, the exact consumption of electricity covered by the subject of the contract cannot be determined. The Contracting Authority has presented an estimate of the amount of electricity consumption and provides that the actual amount of electricity consumption may change, i.e. increase or decrease while maintaining the offered unit prices given in the Contractor's offer. Thus, the indicated estimated electricity consumption does not constitute an obligation for the Ordering Party to purchase electricity in the given quantity.
5. Settlements for the distribution of electricity will take place on the basis of current indications of metering and settlement systems according to the rates of fees resulting from the submitted offer and the Distribution System Operator Tariff, the Seller's Tariff.
6. When submitting an offer, the Contractor must have a contract for the provision of electricity distribution services with a distribution system operator operating in the Ordering Party's premises or a statement that it has an agreement with the Distribution System Operator enabling the provision of electricity distribution services to the Ordering Party's facilities or a statement on ensuring the conclusion of such an agreement.
7. The quality standards referred to in Article 246(2) of the Public Procurement Law are set out in the Energy Law and implementing acts and Polish standards.
8. The Ordering Party shall grant the Contractor a power of attorney to terminate the existing contracts for the sale and distribution of electricity within the framework of applicable regulations and to the extent mutually agreed by the Ordering Party and the Contractor.
