III. DESCRIPTION OF THE SUBJECT OF THE CONTRACT 1. The subject of the contract is the delivery of an intelligent device for stress-free remote monitoring of cattle weight changes in the amount of 27 pieces for the Warsaw University of Life Sciences. 2. Common Procurement Vocabulary (CPV) 38540000-2 – Test and measuring machinery and apparatus. 3. A detailed description of the subject of the contract is included in Annex 3 to the SWZ constituting a description of the subject of the contract together with attachments to this description and in the contract template constituting Annex 13 to the SWZ. 4. The contractor may entrust the performance of part of the contract to a subcontractor. The contractor is obliged to indicate in the tender form the parts of the contract which it intends to entrust to subcontractors and indicate the names of the subcontractors, if they are already known. IV. DESCRIPTION OF PART OF THE CONTRACT 1. The contracting authority does not divide the contract into lots. Thus, the Contracting Authority does not allow the submission of partial bids referred to in Article 7(15) of the PPL. 2. Justification for not dividing the contract into lots: Taking into account the specificity of the contract, the Contracting Authority stated that the division of the public contract into lots, giving the opportunity to choose different contractors to simultaneously implement the presented scope of services, is unjustified. The contracting authority justifies this by the fact that the supplies covered by the subject of the contract are closely related, are homogeneous, and the division of these supplies to be performed by different contractors would cause significant difficulties in coordinating the activities of contractors by the contracting authority, and consequently could hinder the achievement of minimum project indicators. The contracting authority is interested in achieving one and the same effect and achieving the goal for all locations where the system equipment is to be installed and achieving uniform indicators of cow monitoring and demonstrations.
The procedure is conducted in the following mode: 1 open tender 2. The proceedings are conducted using the procedure referred to in Article 139 of the PPL Act (the so-called reverse order of assessment). The contracting authority may first examine and evaluate the bids, and then make a subjective qualification of the contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure.
