Description:
Transportation of disabled people to the World Youth Day with their return to their place of residence

1. The subject of the contract is the service of transporting about 120 disabled people to Community Self-Help Homes (WYD), along with the transport of these people to their place of residence, in the Municipality of Krakow, on the terms set out in the model contract. The scope of transport work envisaged is determined by approximately 2880 monthly subscriptions, i.e. one monthly subscription entitles one disabled person to use transport within one calendar month, subject to § 5 clauses 8, 10 and 12 of the model contract.

2. A detailed description of the subject of the contract is included in the contract template with attachments, constituting Annex 12 to the SWZ.

1.These proceedings are proceeded, in accordance with the Act of 11 September 2019 – Public Procurement Law, hereinafter referred to as the "Act", in an open tender, using a prior evaluation of bids, in accordance with Article 139 of the Act, with the proviso that each Contractor is obliged to submit together with the offer the statements referred to in points 6.1.7. and 6.1.8. SWZ.

2.In these proceedings, the contracting authority does not divide the contract into lots or allow partial tenders. The justification for withdrawing from the division of the contract into lots is indicated in point 3.5 of the SWZ.

3.The contracting authority does not require the performance of the contract by sheltered workshops, social cooperatives or other contractors covered by the provision of Article 94 paragraph 1 of the Act.

4.The Contracting Authority, pursuant to Article 95(1) of the Act, requires employment on the basis of an employment relationship by the Contractor (or subcontractor) of a person/persons performing activities in the dispatching and coordinating position. The performance of these activities consists in performing work in the manner specified in Article 22 § 1 of the Act of 26 June 1974 – Labour Code (i.e. Journal of Laws of 2023, item 1465).

Remark! The above requirement does not apply to the offerors: natural persons conducting business activity who undertake to personally provide the services specified above and partners of partnerships who undertake to personally provide these services to the company.

5.The contracting authority provides for the possibility of awarding contracts referred to in Article 214 paragraph 1 point 7 of the Act in the amount not exceeding 100% of the value of the basic contract, i.e. PLN 2 880 000.00 net. These orders will consist in repeating similar services – in relation to those described in these proceedings in the model contract and annexes. The conditions under which the above-mentioned contracts will be awarded will correspond to the conditions set out in this procedure in the model contract and its annexes, but the conditions for participation in the procedure will be limited to the repeated scope of the contract.

6.The estimated total value of the contract indicated in section II.1.5) includes the amount referred to in point 5 above.

7.The Contracting Authority does not provide for an electronic auction.

8.The contracting authority did not conduct preliminary market consultations before initiating the procedure.

9.In these proceedings, the Contracting Authority does not require the Contractors to submit the evidence in question.

10.The Contracting Authority, within the limits specified in the provisions of Article 462 et seq. Act, allows for the possibility of implementing the subject of the contract by the Contractor with the use of subcontractors in accordance with the Act.

11.Us service shall be carried out using the Contractor's dispatching service using the Contractor's own cars or those at its disposal in accordance with § 2 clause 2 of the model contract.

12.The Contracting Authority requires that the Contractor, throughout the entire period of performance of the subject of the contract, ensures the appropriate share of electric vehicles or vehicles powered by natural gas in the fleet of vehicles used in the performance of the contract in accordance with the requirements set out in Article 68 paragraph 3 of the Act of 11 January 2018 on electromobility and alternative fuels. The vehicles referred to in the previous sentence shall be understood as vehicles defined in Article 2(33) of the Act of 20 June 1997. Road Traffic Law, and electric vehicles and vehicles powered by natural gas referred to in paragraph 2 should be understood as vehicles defined in Article 2 respectively points 12 and 14 of the above-mentioned Act on electromobility and alternative fuels.

13.The Contractor is obliged to have and maintain throughout the entire period of performance of the contract an appropriate civil liability policy in the scope of the conducted activities related to the subject of this contract (also for damage caused by subcontractors) for the sum insured amounting to at least PLN 600,000.00, throughout the entire period of performance of the subject of the contract.
