The subject of the contract is the purchase of electricity in an estimated amount of 8 877.771 MWh in the period from 01.06.2023. (planned date of commencement of electricity supply) by 31.12.2023. for the facilities of the Company "Wodociągi Kieleckie", in accordance with the provisions of the Energy Law of 10 April 1997 (consolidated text, Journal of Laws of 2022, item 1385, as amended).

The Ordering Party indicates that this is an estimated amount of energy, while the Ordering Party will pay for the actual amount of energy supplied in the indicated period.

1. The subject of the contract is the purchase of electricity in the estimated amount of 8 877.771 MWh in the period from 01.06.2023. (planned date of commencement of electricity supply) by 31.12.2023. for the facilities of the Company "Wodociągi Kieleckie", in accordance with the provisions of the Energy Law of 10 April 1997 (consolidated text, Journal of Laws of 2022, item 1385, as amended). The Ordering Party indicates that this is an estimated amount of energy, while the Ordering Party will pay for the actual amount of energy supplied in the indicated period.

The Ordering Party reserves that the above-mentioned estimated amount of electricity purchase may be increased by 10% or reduced by 5% during the period of performance of the subject of the contract. The Contractor is not entitled to any claim against the Ordering Party for not consuming the expected amount of energy.

The Ordering Party declares that it is an eligible customer in accordance with the provisions of the Act of 27 October 2022 on emergency measures aimed at limiting electricity prices and support for certain customers in 2023. If there are grounds for applying the provisions of the Act above, the Contracting Authority shall submit an appropriate statement in this respect to the Contractor selected in the tender procedure in question, immediately after signing the contract for the performance of the contract.

2. Under this contract, the Contractor is obliged to provide services in the field of resale of electricity generated by the Contracting Authority as a Generator in renewable electricity sources and in the scope of commercial balancing on the terms set out in the Energy Law of 10 April 1997 (consolidated text, Journal of Laws of 2022, item 1385, as amended), in accordance with the applicable executive acts to the aforementioned Act and the provisions of the Act of 23 April 1964 Civil Code (consolidated text, Journal of Laws of 2022, item 1360, as amended), the rules set out in concessions, the provisions of the Agreement concluded as a result of these proceedings and based on the PPL Act. The place of electricity generation by the Ordering Party and being the subject of possible resale is a biogas power plant, located in the "Sitkówka" Sewage Treatment Plant in Nowiny near Kielce, 93 Przemysłowa Street (Journal No. 148/16), 26-052 Sitkówka-Nowiny with a capacity of 0.806 MW.

In addition, the Ordering Party informs that in 2023 it does not provide for the introduction of energy into the DSO network.
