Description:
Collection and management of municipal waste from the Świerklany commune

4.2.1. The subject of the contract includes the collection and management of municipal waste from the area of the Świerklany Commune:

a) from real estate on which residents live and from real estate on which residents do not live and municipal waste is generated,

b) collected in containers located at the Selective Municipal Waste Collection Point located in Świerklany at 5 Pogodna Street;

c) construction and demolition waste, furniture and other bulky waste and used tyres, collected within additional periods, at the individual request of the owner of the property on which the residents live.

4.2. Detailed description of the subject of the contract:

4.2.1. The subject of the contract includes the collection and management of municipal waste from the area of the Świerklany Commune:

a) from real estate on which residents live and from real estate on which residents do not live and municipal waste is generated,

b) collected in containers located at the Selective Municipal Waste Collection Point located in Świerklany at 5 Pogodna Street;

c) construction and demolition waste, furniture and other bulky waste and used tyres, collected within additional periods, at the individual request of the owner of the property on which the residents live.

4.2.2. A detailed description of the subject of the contract is included in Annex 1 to the SWZ.

16.16. A joint bid submitted within the meaning of Article 58 of the Public Procurement Law by two or more Contractors:

16.16.1. Contractors acting jointly are obliged to appoint a Representative to represent them in the procurement procedure or to represent them in the proceedings and conclude a public procurement contract.

In the case of a civil law partnership, the offer should be accompanied by a current articles of association or a resolution of the partners, indicating one of the partners as authorized to represent the company (all partners).

16.16.2. The power of attorney document must be signed by the principal(s). Signatures must be submitted by persons authorized to make declarations of intent, listed in the relevant register.

16.16.3. The offer must be signed in such a way as to legally bind all Contractors acting jointly (by each of the Contractors or an authorized representative).

16.16.4. The declaration referred to in Article 125 of the Public Procurement Law (according to Appendix 16) shall be submitted by each of the Contractors jointly applying for the contract. This statement confirms that there are no grounds for exclusion.

This means that:

a) a statement regarding the absence of grounds for exclusion must be submitted by each of the Contractors jointly applying for the award of the contract,

b) a statement on meeting the conditions for participation in the proceedings shall be submitted by the Contractor who meets this condition.

16.16.5. All correspondence shall be conducted by the Ordering Party only with the Proxy.

16.16.6. If the offer of the Contractors acting jointly is selected as the most advantageous, the Contracting Authority shall request before the conclusion of the Public Procurement Agreement to submit a copy of the Agreement regulating the cooperation of these Contractors.

16.16.7. The agreement regulating the cooperation of Contractors submitting a joint bid should specify at least:

a) entities submitting a joint offer,

b) indication of the Leader to represent partners (co-contractors) in the performance of the contract,

(c) the economic purpose for which the contract was concluded,

d) indication of the duration of the Agreement,

e) a statement that the Consortium Leader is the only entity to which subcontractors' invoices will be issued. The contracting authority will not honor solutions consisting in issuing invoices by subcontractors to a consortium member.

16.16.8. A consortium agreement cannot be a preliminary agreement or a contract concluded under a suspensive condition.

16.16.9. Partners of a civil-law partnership are treated as contractors submitting a joint offer, and the rules set out in point 16.16 apply to them.
