The subject of the tender is the conclusion of a trading partner framework agreement for the purchase of Microsoft software licenses, software maintenance and extended security updates, including supporting services.

The purchase must be made by joining the Enterprise Agreement (EA) to the terms and conditions contracts (BMI framework agreements) concluded between the Federal Ministry of the Interior and Community (BMI) and Microsoft Ireland Operations Ltd. valid on 01.12.2023. Accession takes place after the conclusion of the trading partner framework agreement. Its inducement with effect for all clients is part of the tendered service.

On the one hand, it should be possible to purchase the Microsoft products listed in the price sheet (Appendix 3, Table 1).

On the other hand, a surcharge or discount granted by the Contractor is requested, which applies to all procurements of Microsoft products (licenses, software maintenance and extended security updates) that are generally available under the BMI framework agreements and are not explicitly listed in Appendix 3, Table 1. These can be new requirements as well as integrations of maintenance into existing Microsoft contracts.

The Contractor shall ensure that services will commence on 01.12.2023 so that existing software maintenance from expiring contracts can be continued seamlessly. In concrete terms, this means that the contractual basis for order processing with Microsoft has been created by then and the order has been processed by the Contractor vis-à-vis Microsoft to such an extent that operation is ensured on 01.12.2023. The contractor is responsible for this.
