Description:
Supply of electricity in 2023 to the Sulejów Commune and its subordinate units - Part 1

The subject of the contract is the purchase of electricity for the municipality of Sulejów and its subordinate units in 2023 for a period of 6 months, a total of up to 168 energy consumption points on equal price conditions for 1 kWh for all tariffs. A detailed description of the subject of the contract is a table with an indication of electricity consumption points and their expected energy demand for a period of 6 months – Annex. No. 1 to SWZ – Detailed description of the subject of the contract. The estimated electricity consumption for the indicated period is 1 448 222 kWh. The forecast of energy consumption indicated in the Detailed description of the subject of the contract is only an approximate value, which may change during the performance of the contract, and the actual energy consumption (less or greater than the forecast indicated in Annex 1 to the SWZ) will depend only on the actual needs of the Ordering Party, and the Contractor is obliged in each case to apply the energy prices offered in the tender. According to SWZ.

The estimated demand for electricity is only indicative, used to compare offers and in no case does it constitute an obligation on the part of the Ordering Party to purchase energy in the given quantity.

The Contractor may not assert any financial claims from the Ordering Party (e.g. compensation) if, during the term of the contract, the Ordering Party purchases from the Contractor a smaller or larger amount of electricity than forecasted, indicated in the detailed description of the subject of the contract - Appendix No. 1 to THE SWZ, in particular caused by an increase or decrease in the amount of PPE.

The Ordering Party requires that the Contractor performing the order at the latest on the date of conclusion of individual sales contracts has concluded a binding contract with the local Distribution System Operator (DSO), on the basis of which it is possible to sell electricity via the distribution network of this DSO to all facilities and equipment of the Ordering Party indicated in Appendix No. 1 to SWZ.

The Contractor, on the basis of the power of attorney granted, will be obliged to take the necessary actions towards the termination of the contracts for the sale of electricity in force to the Ordering Party.

The Ordering Party shall grant the Contractor selected in the proceedings a power of attorney to represent the Ordering Party in contacts with the existing Electricity Seller or the Distribution System Operator in matters related to the process of changing the Seller - it applies to the collection points included in Appendix No. 1 to the SWZ.

The Ordering Party shall grant the Contractor selected in the proceedings a power of attorney to represent the Ordering Party in contacts with the Distribution System Operator in matters related to the process of notifying the Seller for new electricity consumption points, to which the Ordering Party has received from the DSO the number of the contract for the provision of electricity distribution services.

Appendix No. 1 to the SWZ indicates the current parameters (tariff group/contractual capacity), which may be subject to change during the term of the electricity sales contract.

The Ordering Party informs that it does not have:

a) the status of the producer referred to in Article 2(39) of the Act of 20 February 2015 on renewable energy sources (Journal of Laws of 2022, item 1378, as amended),

b) the status of a renewable energy prosumer referred to in Article 2 point 27a of the Act of 20 February 2015 on renewable energy sources (Journal of Laws of 2022, item 1378, as amended).

The electricity collected from the grid will be entirely allocated to the Ordering Party's own needs.

The Contracting Authority does not plan to obtain energy from another generation source, e.g. photovoltaic installations, biogas power plants, during the term of the contract.

The Ordering Party does not have a micro-installation.

The Ordering Party has no agreements/annexes concluded as part of loyalty promotional campaigns.

The Ordering Party agrees to conclude the contract by correspondence.

The Ordering Party allows the Buyer and the Recipient's designation to be entered on the invoices in accordance with the Contractor's proposals.

The Ordering Party, if necessary, will proceed with the change of the electricity seller once again.

The Ordering Party has no comprehensive agreements concluded.

The Energy Supplier is obliged to have a distribution agreement concluded with the Distribution System Operator (DSO) competent for the Ordering Party's facility, at the latest on the date of conclusion of the contract regarding the contract in question and for a period not shorter than the duration of the contract with the Contractor.

The Contractor undertakes to provide the Ordering Party with quality standards of service in accordance with the binding provisions of the Energy Law.

The Contractor will be obliged to act as an entity responsible for commercial balancing for electricity sold under the subject of the contract.

The Ordering Party does not require the means of proof in question.
