The contract is for the appointment of a multidisciplinary team - called “Project Author” - responsible for the complete task of programming, study, monitoring and coordination of the works, as described in Parts III and IV of the Special Specifications, for the complete renovation of the OLD-tech building, as well as all the ancillary works. generated by the latter.

For this project author assignment, the contracting authority wishes to appoint a multidisciplinary team composed of an architect, a stability engineer, a special techniques engineer, an EPB advisor, an interior designer, and a health safety coordinator.

The contracting authority wishes to have a direct contractual link with the architect and the engineer in special techniques.

Applications that do not guarantee the client, from the selection phase to benefit from this direct contractual link will be rejected.

For other missions, subcontracting is authorized. (The stability engineer, the interior designer, the acoustician, an expert in hospital programming, PEB advisor, a safety coordinator, graphic designer for signage, etc.)

In the event that the specific personnel necessary to carry out all of the planned assignments do not meet within the same professional structure, a team of participants is formed into a group of economic operators.

The person who will represent the group vis-à-vis the contracting authority, and who will be responsible for coordinating the studies and services carried out by the other members of the group, is the architect.

In derogation from Article 4:14 of the Code of Companies and Associations, the members of the group will only see their respective responsibility questioned within the limits of the accomplishment of their own mission.

Pursuant to Article 55 of the Royal Decree of 18 April 2017, the submission of a joint offer by several selected candidates is prohibited.

When the contract documents refer to the tenderer, the successful tenderer and the project author, we mean the above-mentioned multidisciplinary team.

The attention of economic operators submitting several applications in isolation and in groups with other economic operators, or within differently composed groups and groups in which they participate is drawn to the prohibition of multiple participations at the tender stage by Article 54 (2). of the royal decree of 18 April 2017. The consequence of this prohibition is that tenders submitted by tenderers involved in multiple participation will all have to be rejected.

If the two candidates concerned by the multiple participation of an economic operator are selected, the latter may only submit an offer in the context of one of the two candidates. Applicants concerned must anticipate this situation to avoid rejection of their offer.

In the event of multiple participation of one or more economic operators, the selection procedure shall be carried out as follows:

1. As a first step, the contracting authority will carry out the analysis and provisional ranking of the applications concerned, taking into account possible duplicates;

2. In a second step, it will inform the groups concerned by a risk of double offer of their provisional ranking and will invite the operators present in several groups to choose the one by which the offer is introduced;

3. In a third step, it will proceed to the final ranking of the applications after the withdrawal of one or more groups concerned by the risk of a double offer and will invite the various candidates to formulate an offer.
