Full name of the contract: "Removal of vehicles from roads in the Municipality of Dąbrowa Górnicza and running a guarded car park for storing vehicles removed pursuant to Article 130a of the Act of 20 June 1997. Road Traffic Law (i.e. Journal of Laws of 2022, item 988 with późn.zm.), storage on the Contractor's premises of vehicles removed pursuant to Article 130a of the Prd Act and not collected within the statutory period, as well as vehicles removed under Article 50a of the Prd Act and dismantling in accordance with the provisions of the Act of 20 January 2005 on recycling of end-of-life vehicles (i.e. Journal of Laws of 2020, item 2056 with later dates. as amended)."

1. Description of the item of the order

As part of the implementation of the subject of the contract, the Contractor will be obliged to perform the following activities:

1. Removal of vehicles from the roads, which will take place at the request of authorized entities on the basis of their instructions to remove the vehicle from the road in accordance with Article 50a and Article 130a of the Road Traffic Act (...)

2. Storage of vehicles removed from the roads in a guarded parking lot until the vehicle is collected by a person authorized to collect it or until the vehicle taken over for the benefit of the Municipality is dismantled or sold by tender or public auction;

3. Dispose of a car park in the Municipality of Dąbrowa Górnicza, intended for storage within the statutory period of 3 months of vehicles removed from the roads on the basis of Article 130a of the Prd Act, until collected by an authorized person with an area of not less than 950 m² meeting the following requirements: location within the administrative boundaries of the city of Dąbrowa Górnicza; surveillance in the form of round-the-clock monitoring of cameras and security surveillance; fenced, with an entrance gate, illuminated, with a hardened surface (min. 700 m²), i.e. land surface: bituminous mass or gravel or concrete or of paving stones or triline; having: a secured room for storing parts or elements of vehicles and their equipment that could be destroyed or lost in the parking place, in accordance with the detailed requirements set out in the Offer Form – Table 3;

4. Dispose of land intended for storing vehicles removed pursuant to Article 130a of the Prd Act and not collected by an authorized person within the statutory period of 3 months, and intended for storing vehicles removed pursuant to Article 50a of the Prd Act with an area of not less than 950 m², having at least the following technical features: location within the administrative boundaries of the city of Dąbrowa Górnicza; surveillance in the form of round-the-clock monitoring of cameras and security surveillance; Fenced; having an entrance gate; Lit; with a hardened surface (min. 700 m²), i.e. land surface: from bituminous mass or gravel or concrete or from paving stones or triline; having a secured room for storing parts or components of vehicles and their equipment in accordance with the detailed requirements set out in the Offer Form – Table 4;

5.The area referred to in point 4 may be located in the place of a guarded car park listed in point 3, provided that the total area of the guarded car park and the area will total a minimum of 1900 m² and minimum requirements appropriate for each of them are ensured.

6. The Contractor is obliged to travel to the place of towing the vehicle from the moment of receiving a telephone notification from authorized entities (Police, Municipal Guard, Road Transport Inspection, person commanding the rescue operation) within 60 minutes, under pain of penalties in accordance with § 7 section 1;

7. Round-the-clock, i.e. 24 hours a day, 7 days a week, receiving vehicles removed on the basis of instructions issued to a guarded parking lot, having round-the-clock telephone communication;

8. Have technical devices necessary to perform the order, i.e.: min. 1 vehicle adapted to tow vehicles with a maximum permissible weight of up to 3.5t, min. 1 vehicle adapted to tow vehicles with GVW from 3.5t to 7.5t, min. 1 vehicle adapted to tow vehicles with GVW from 7.5t to 16t, min. 1 vehicle adapted to tow vehicles with a GVW above 16t; and tools necessary to prepare the vehicle and its elements for loading and protection against damage or theft during transport, to organize the scene of the incident from post-accident waste.

9. Preparation of photographic documentation confirming the external condition of the removed vehicle at the stage of taking it over from the authorized entity;

10. Transfer the vehicle to a guarded parking lot referred to in point 3 or the area specified in point 4, on the basis of a properly completed instruction to remove the vehicle issued by an authorized entity, including (...) continuation of the description of the contract in Chapter II, point 1 SWZ.
