The purpose of this study is to describe the different national systems regulating commercial establishment across the EU and to undertake a comparative assessment of these systems in the light of their compatibility with EU internal market rules, in particular with the freedom of establishment and the Services Directive.

This study feeds into the follow-up of one of the 11 actions from the European retail action plan adopted on 31.1.2013.
