The subject of the contract is the supply of electricity to the Ordering Party's electricity consumption points on the terms set out in the Act of 10 April 1997. Energy Law (consolidated text) Journal of Laws of 2022, item 1385, as amended), hereinafter referred to as the "Energy Law" and in implementing acts issued on its basis, with specific quality standards. Electricity quality standards are described in the Energy Law, in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007, No. 93, item 623, as amended), in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading (Journal of Laws of 2022, item 2505 with the n. Deaths).

Detailed description of the subject of the contract:

1. The subject of the contract is the supply of electricity to the Ordering Party's electricity consumption points on the terms set out in the Act of 10 April 1997. Energy Law (consolidated text) Journal of Laws of 2022, item 1385, as amended), hereinafter referred to as the "Energy Law" and in implementing acts issued on its basis, with specific quality standards. Electricity quality standards are described in the Energy Law, in the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the power system (Journal of Laws of 2007, No. 93, item 623, as amended), in the Regulation of the Minister of Climate and Environment of 29 November 2022 on the method of shaping and calculating tariffs and the method of settlements in electricity trading (Journal of Laws of 2022, item 2505 with the n. Deaths).

2. The estimated total amount of electricity to be supplied during the term of the Agreement is 10,817,770 MWh, including 1558,750 MWh for street lighting.

3. The Contracting Authority requests the Contractor to indicate in the "Offer Form" constituting Annex 1 to the SWZ the parts of the contract whose performance it intends to entrust to subcontractors and to provide the names of possible subcontractors, if they are already known.

4. The Contracting Authority shall not reserve the obligation for the Contractor / individual Contractors to perform key tasks jointly applying for the award of a public contract.

5. In accordance with Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine, the performance of a public contract involving subcontractors, suppliers or entities whose capacities are relied on within the meaning of Directive 2014/24/EU referred to in Article 5k of that Regulation shall be prohibited where they account for more than 10 % of the contract value.

6. The Ordering Party informs that:

- does not provide for an option,

- does not provide for the renewal of the contract,

- does not request the evidence in question

7. A detailed description of the subject of the contract and the requirements and rules for the performance of the contract are specified in the model contract constituting Annex 3 to the SWZ together with the list of electricity consumption points constituting Annex 4 to the SWZ.
