1. The order concerns the purchase of active electricity available on the market that meets the quality standards set out in the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2018, item 755, as amended) in the total estimated amount of 5,043 , 90 MWh, for 46 Employer's power consumption points specified in the Annexes to this specification divided into tariff groups. The Employer declares that he is the final recipient within the meaning of the Energy Law (i.e. Journal of Laws 2018, item 755 as amended), which means that the electricity purchased from the Contractor is intended solely for own needs not related to the energy trading activity electricity, distribution of electricity or generation of electricity.
2. A detailed description of the subject of the contract is provided in Annex 1 to the ToR.

The order concerns the purchase of active electricity available on the market that meets the quality standards set out in the Act of 10.4.1997 Energy Law (consolidated text Journal of Laws of 2017, item 220, as amended) in the total estimated quantity of 5,043 , 90 MWh, for 46 Employer's power consumption points specified in the Annexes to this specification divided into tariff groups. The Employer declares that he is the final recipient within the meaning of the Energy Law (Journal of Laws 2017, item 220 as amended), which means that electricity purchased from the Contractor is intended solely for own needs not related to the electricity trading activity, distribution of electricity or generation of electricity.
2. A detailed description of the subject of the contract is provided in Annex 1 to the ToR. Detailed information on individual energy consumption points is presented in Annex 1.1. and 1.2 to the Detailed Description.
3. Declared in para. 1 electricity consumption is an estimate and is used to calculate the price of the offer and compare it. The data contained in Annex 1.2 to the Detailed description of the subject of the contract, regarding the estimated energy consumption have been prepared on the basis of the historical energy consumption profile and current tariff groups.
4. The Purchaser reserves the right to change the amount of energy actually supplied during the contract period in terms of the forecasted energy volume [MWh] in individual tariff groups, given in the Offer Form constituting Annex 2 to the ToR. In the event of a change in the estimated energy consumption by the Employer, this will not result in additional costs, except for billing for the actual amount of energy consumed at unit prices specified by the Contractor in the Offer Form. The Contractor shall not have any claims against the Employer in this respect.
5. The Contractor may submit only one offer for the entire order specified in this ToR.
6. This contract does not include the electricity distribution service.
7. For all PPEs, this is another change of seller and the Purchaser has concluded contracts for the distribution of electricity for an indefinite period.
8. For the implementation of the subject of the contract, the Contractor must have a valid contract, i.e. General Distribution Agreement, with the local Distribution System Operator (hereinafter: DSO), on the basis of which it may sell electricity through the distribution network of this DSO to all indicated facilities covered by the procedure.
9. The consumption points referred to in these ToR should be understood as points in the network to which the Operator supplies electricity, specified
In the contract for connection to the network or in the contract for the provision of electricity distribution services, which is also the place of receipt of this energy.
10. One contract of sale of electricity will be concluded for the subject of the order.
11. The Employer does not provide for a meeting of Contractors referred to in art. 38 section 3 of the PPL Act.
12. The performance of the contract is subject to Polish law, in particular the Energy Law, the Act of 23.4.1964 Civil Code (i.e. Journal of Laws of 2017, item 459, as amended) and the Act of PPL.
