The subject of the contract is a comprehensive supply of gaseous fuel – high-methane natural gas type E, including the sale and distribution of gas for the needs of 30 dormitory quarters belonging to the resources of the AMW Regional Branch in Lublin and a gas boiler room located in the building at 10 St. Kingi Street in Rzeszów, listed in the attachment "Description of the subject of the contract" with the maximum amount of fuel demand for tariff groups W-1.1, W-2.1 (303 800 kWh), while for the tariff group W-5 (1 857 000 kWh).
1. The subject of the contract is a comprehensive supply of gaseous fuel – high-methane natural gas type E, including the sale and distribution of gas for the needs of 30 dormitories belonging to the resources of the AMW Regional Branch in Lublin and a gas boiler room located in the building at 10 St. Kingi Street in Rzeszów, listed in the attachment "Description of the subject of the contract" with the maximum amount of fuel demand for tariff groups W-1.1, W-2.1 (303 800 kWh), while for the tariff group W-5 (1 857 000 kWh).
2. Gaseous fuel should be delivered around the clock to the delivery and demand points listed in Annex 1 to the SWZ, which is a set of gas equipment used to connect the internal network, owned by the Ordering Party with the gas network of the system operator.
3. The demand for gaseous fuel was assumed on the basis of the previous consumption of gaseous fuel and may differ from the actual use of gaseous fuel, because it is not possible to determine in advance the amount of gaseous fuel that will be delivered to the Ordering Party. The quantity of the order does not constitute an obligation on the part of the Ordering Party to purchase gaseous fuel in the given quantity and in no case may it be the basis for any claims on the part of the Contractor. In the course of the contract, the Ordering Party has the right to:
3.1. reduction of the amount of gaseous fuel, with the minimum size being 80% of the order volume indicated in paragraph 1 above. The change does not affect the offer price. The change takes place automatically and does not require the Ordering Party to submit a declaration of intent,
3.2. changes in the tariff group, in accordance with the principles set out in the tariffs approved by the President of the Energy Regulatory Office. The change takes place automatically and does not require the ordering party to submit a declaration of intent,
3.3. changes in the tariff group, in order to optimize distribution parameters or to ensure the proper functioning of the facility (in accordance with its intended purpose). The change does not affect the offer price. The change does not affect the offer price. The change requires a declaration of will by the Ordering Party.
4. PPG addresses, tariff groups, contract data, consumption and other necessary information are included in Annex 1 to the SWZ.
5. Information on the agreements currently in force is described in Annex 1 to the SWZ in the "Term of validity" column.
6. The contracting authority for all points covered by the procedure is an entity authorized to settle the purchase of gas at tariff prices approved by the President of ERO within the meaning of the Act of 26 January 2022 on special solutions for the protection of gas fuel consumers in connection with the situation on the gas market and will sign the STATEMENT OF THE RECIPIENT OF GASEOUS FUELS on the purpose of the gaseous fuel, according to the template attached to the Regulation of the Minister of Climate and Environment of 28 January 2022. This Preliminary Statement (without providing the numbers of the contract(s) is an attachment to these proceedings. The Ordering Party reserves the right to change the scope of the Statement during the term of the order, i.e. the loss of the right to settle according to tariff prices. In such a case, the Ordering Party shall submit an appropriate statement in accordance with the factual and legal status
