1. The subject of the order is the supply of electricity for the Commune of Wisłoka Commune and Communes: Biecz, Brzostek, Czarna, Dębowiec, Jodłowa, Krempna, Osiek Jasielski, Skołyszyn, Tarnowiec, Grybów and Powiat Gorlicki and their Organizational Units (code CPV 09300000-2, 09310000-5). All Energy Consumption Points are listed in Annex 3 to the ToR from 1 January 2020 to December 31, 2020.
2. The estimated amount of electricity consumption (guaranteed contract) for the duration of the contract for the entire purchasing group is: 15788.05 MWh. It is expected that the number of energy consumption points in the contract period may be increased, for example, by newly built street lighting, lighting squares and illuminations of buildings and walls, as well as newly built or acquired buildings or buildings, etc.
The values indicated in the SIWZ Annex are estimates, which does not reflect the real or declared use of electricity during the duration of the contract and in no case may be the basis for any claims on the part of the Contractor. Actual settlements will be based on current indications of measurement and billing systems for the supply of electricity in accordance with the Contractor's offer
The estimated amount of electricity consumption (guaranteed contract) for the duration of the contract for the entire purchasing group is: 15788.05 MWh. It is expected that the number of energy consumption points during the contract period may be increased, eg by newly built street lighting, lighting squares and illuminations of buildings and walls, as well as newly built or acquired buildings or buildings etc. The contractor will be obliged to supply energy to facilities specified in the Annex to the Terms of Reference and to new collection points to be built and connected to the network. The lists of new collection points will be forwarded to the contractor by email or by post. The demand for electricity may also increase if electricity consumption is increased. Any increase in energy consumption and the increase in the number of energy consumption points will be made within the scope of the contract, taking into account the option's right. Increasing the collection points or changing the tariff group is possible only within tariff groups, which are included in the ToR and measured in the Bidder's Bid Form.
Due to the changing real energy demand, the Ordering Party, in accordance with the provisions of art. 34 par. 5 PPL, provides for the possibility of exercising the right of the option consisting in increasing the guaranteed scope of the contract, i.e. increasing the amount by a maximum of 10% of energy for each part of the contract. Expected changes in the energy demand and the resulting change in the amount of anticipated consumption are not dependent on the customer, and result from the changing demand for energy.
The implementation of the contract covered by the law option is the contracting authority, from which he may or may not take advantage. Settlement for the kWh options covered by the scope of the law over the amount indicated in section 3 of the Terms of Reference will be based on the prices specified in the offer form. It is stipulated that the number of energy consumption points in the contract period may be reduced in the case of, for example, sale or fire of a building, liquidation of lighting etc. Lists of liquidated collection points will be forwarded to the contractor by electronic means or by post. Increase and reduction of energy consumption points will be possible on the basis of a bilaterally signed annex to the agreement concluded with the contractor for the supply of electricity. The Ordering Party obliges the Contractor to submit to the indicated Distribution System Operator the contract of sale of electricity concluded with the Contractor, submit declarations of will and determine on behalf of the Employer all necessary information regarding the termination of the current electricity sales and distribution services, representing the Ordering Party before the actual System Operator Distribution in matters related to the conclusion of a contract for the provision of distribution services.
The Contracting Authority informs that the process of changing the seller takes place for the majority of the collection points once again. Detailed information is contained in Annex 3 to the ToR.
The Contractor undertakes to provide the Employer with the quality standards of customer service in accordance with the applicable provisions of the Energy Law, i.e. on conditions specified by the provisions of the Act of April 10, 1997 - Energy Law and in accordance with executive regulations issued to this law, in particular with the standards of customer service quality specified in Regulation of the Minister of Energy
