Description:
Lomzhina Buying Group. Supply of electricity in the period from 01.01.2022r. to 31.12.2022r.

1. The subject of the contract is the supply of electricity between 01.01.2022r. and 31.12.2022r. to 957 points of consumption (PPE) with a total estimated volume (+/- 10%) of 9,937,03 MWh, of which:

1) For premises and facilities (Part 1 of the order) — 6 714,75 MWh — Detailed list of PPE is Annex 1a to SWZ

2) For road lighting purposes (Part 2 of the order) — 3 222,28 MWh — the detailed list of PPE is Annex 1b to SWZ

2. The forecast electricity consumption indicated above is indicative and may deviate from the amount of energy actually collected, during the duration of the contract. Reducing or increasing the amount of electricity does not entail any consequences for the contracting (customers), other than the need to pay for the amount of energy actually collected.

Supply of electricity to premises and facilities

1. Number of measurement systems accounting for consumed electricity 344 pcs

2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1a to the SWZ.

3. Estimated electricity consumption over the term of the contract of 6,714.75 MWh, of which:

Zone I 3,413.75 MWh

Zone II 1,006.00 MWh

Zone III 2,295.00 MWh

The above data is indicative. The Contractor should take into account possible fluctuations in electricity consumption at a level of +/ -10%).

4. Deliveries will take place between 01.01.2022 and 31.12.2022, provided that the details of delivery times (commencement and termination) for individual collection points are described in Annex 1a to SWZ column “Delivery period”.

5. Łomżyński County — item 1 (PL_ZEBB_2007000079_03) in Annex No 1a to SWZ - the contracting officer uses the RES installation on the Starostwa facility since 2018 - does not have the status of Prosument.

6. Cardinal Stefan Wyszyński Provincial Hospital in Łomża on the facilities:

1) item 1 (PL_ZEBB_2062016428_04) of Annex 1a to SWZ

2) item 2 (PL_ZEBB_2062022868_00) of Annex 1a to SWZ

3) item 4 (PL_ZEBB_2062030655_01) of Annex 1a to the SWZ,

the contracting operator has been using the RES installation since 2015 — does not have the status of Prosument.

7. Measuring systems with the tariff group B are adapted to the procedure of changing the seller.

8. The current electricity supply contracts will expire or terminate with effect on the day prior to the planned start date (“Supply Period” column). The obligation to terminate contracts is on the side of the contracting (recipients).

9. As a result of the settlement of the proceedings, 15 contracts will be concluded

10. The Contracting Authority requests to bring a defect in the height of 90.000,00PLN

11. The Contracting Authority requests to provide a security of due performance of the contract at a height of .5% of the value of the contracts - does not apply to the contract with the Municipality of Rutka The Contractor will contribute 14 separate safeguards.

12. Quality standards

1) The subject of the order is the supply of electricity with certain quality standards in accordance with applicable regulations.

2) The quality standards of electricity are described in the Act of 10 April 1997 — Energy Law and the Regulation of the Minister of Economy of 4 May 2007 on the detailed conditions for the operation of the electricity system (as amended) and the Regulation Minister of Energy of 6 March 2019 with amendments on detailed rules for the formation and calculation of tariffs and clearing in electricity trading

13. Distribution services are/will be provided on the basis of separate contracts concluded between contracting agents (customers of electricity - hereinafter “the Recipients”) and the distribution system operator (DSO).

14. The Contractor shall, on the basis of the Power of Attorney granted, be required to notify on behalf of his own and the Contractor (recipients) of the contracts to the relevant DSO in accordance with the applicable rules and to represent the Contractor (recipients) before the DSO - the process of changing the seller.

15. For all PPE, the contracting party (recipients) have the status of consignee, so they are entitled to purchase energy from the seller of their choice /art.4j (1) of the Energy Law of 10 April 1997/.

16. The duration of the contract indicated in Section II.2.7 relates to the delivery period. The agreement will be valid from the date of signing by the parties.

Supply of electricity for the needs of road lighting

1. Number of measurement systems accounting for consumed electricity 613 pcs

2. A detailed description of the pre-emptive points (PPE) of the Contracting Party included in Annex No 1b to the SWZ.

3. Estimated electricity consumption over the term of the contract of 3,222.28 MWh, of which:

Zone I 1,690.93 MWh

Zone II 1 531.35 MWh

The above data is indicative. The Contractor should take into account possible fluctuations in electricity consumption at a level of +/ -10%).

4. Deliveries will take place between 01.01.2022 and 31.12.2022, provided that the details of delivery dates (commencement and termination) for individual collection points are described in Annex No 1b to SWZ column “Delivery period”.

5. The current electricity supply contracts will expire or terminate with effect on the day prior to the planned commencement date (“Supply Period” column). The obligation to terminate contracts is on the side of the contracting (recipients).

6. As a result of the settlement of the proceedings, 11 contracts will be concluded

7. The Contracting Authority requests to bring a defect in the height of 44.000,00PLN

8. The Contracting Authority requests that the security of the due performance of the contract be lodged at .5% of the value of the contracts. The contractor will contribute 11 separate safeguards.
