The proceedings are conducted on the basis of the provisions of the Act of 11 September 2019. The Public Procurement Law – hereinafter referred to as the 'PPL Law' – and implementing regulations issued on its basis, in an open tendering procedure. The contracting authority provides for the application of the procedure referred to in Article 139 of the PPL Act and cancellation pursuant to Article 257 of the PPL.

The subject of the contract is the performance of periodic inspections of the technical condition of buildings in accordance with Article 62 of the Act of 7 July 1994. Construction Law (i.e. Journal of Laws of 2023, item 682, as amended) and preparation of protocols of inspections carried out. The material scope of the contract includes:

1/ Carrying out periodic annual and five-year inspections.

a/The list of objects subject to annual or five-year control together with the location and scope of inspection is presented in Annex 1 to the SWZ

b/ In accordance with Article 62 paragraph 1 of the Act of 7 July 1994. Construction Law (i.e. Journal of Laws of 2023, item 682, as amended) protocols from the inspection of the technical condition of a building should include:

- general information concerning the location and the owner or manager of the structure,

- the extent of the inspection carried out and the materials used,

- general information about the facility along with basic technical parameters,

- description of individual elements of the structure, including, m.in structure, mechanical elements and protections along with their assessment of the technical condition based on the inspection carried out,

- a description of the irregularities involved,

- a description of the implemented and unimplemented recommendations resulting from the previous audit,

- recommendations from the current control in the field of operation, containing possible renovation recommendations and limiting the work of the structure as well as possible comments or reservations and conclusions regarding the further safe operation of the building,

- assessment of the technical condition together with the assessment of the safety status and assessment of the suitability for use of the inspected buildings,

- description of the aesthetics of the building and its surroundings (in the case of a five-year inspection),

2/ In addition, the above-mentioned control should cover in particular:

- building elements exposed to harmful atmospheric influences and destructive effects of factors occurring during the use of the object,

- selected features of the facilities and the environment as well as the technical condition and suitability for use of the entire building,

- checking the technical efficiency and performance value of elements exposed to harmful atmospheric influences and destructive effects of factors occurring during use, the damage to which may pose a threat to the safety of persons and the environment.
