The subject matter of the present award procedure is the procurement of a framework contract for consulting services for the processing of funding programmes.

The object of performance extends to the processing of funding applications within the framework of corona aid and, if necessary, other funding programs. In order to enable timely processing, a deployment of up to 600 MAK is expected. The necessary personnel capacities are to be provided by the contractor. The processing includes the examination of the application and approval of the requested funds as well as the revocation and withdrawal of funding decisions. The processing includes in particular the processing of the final settlement package 1 (bridging assistance I-III, November and December aid), the final settlement package 2 (bridging assistance III Plus and bridging assistance IV) and final accounts of the restart aid. The processing is carried out on the basis of the relevant legal regulations and the other regulations issued for this purpose (e.g. Administrative regulations) and other pronouncements (e.g. FAQ of the Confederation). Processing takes place on the electronic application and processing systems provided by the L-Bank or the Confederation. The service is to be provided remotely. In coordination with L-Bank, the contractor shall take measures for quality assurance, to ensure a functioning reporting system, for training and for the transfer of know-how for the personnel deployed. The service is provided in external rooms, which must be provided by the contractor. The contractor shall provide the personnel employed with the necessary technical infrastructure and usual office equipment for the execution of the task.
The framework agreement obliges the contractor to use persons suitable for the respective fields of activity. At the request of the client, the contractor must be able to prove this at any time.
The persons employed by the contractor are not subject to any right of direction of the client under employment law. An employment relationship is not established. Rather, the contractor provides the services under the framework agreement as an independent company.
The overall responsibility for the project remains with the client.
The framework for the framework agreement to be concluded is up to EUR 110,000,000.00 net. If the framework agreement is automatically extended after expiry of the 24 months, the framework increases by EUR 55,00,000.00 net per year, up to a maximum of EUR 220,000,000.00 net.
The contract is scheduled to be concluded by the end of June 2023. The contract shall commence on 1 July 2023 and shall have a term of 24 months with two (automatic) optional renewals of one year each, unless terminated four months before expiry. The framework agreement ends no later than 30June 2027 without the need for termination.
The framework agreement is concluded with only one company. Individual orders are placed by the client on the basis and under the conditions of the framework contract.
If the client does not call up or require the personnel capacities agreed in the framework agreement in full, the client reserves the right to transfer the unrequired contingent by way of administrative assistance to other institutions of the state of Baden-Württemberg, in particular ministries, for the processing of other funding programmes. In this case, too, the client remains the L-Bank.
