The subject of the contract is the supply of electricity in accordance with the provisions of the Act of 10 April 1997. Energy law to energy collection points of the Ordering Party. A detailed description of the subject of the contract is included in Annex 2 to the SWZ.

1. The subject of the contract is the supply of electricity to PPUH "RADKOM" Sp. z o.o. for a period of 12 months (planned to start from 01.12.2023 - 30.11.2024 within the meaning of the Act of 10.04.1997. Energy Law (consolidated text: Journal of Laws of 2022, item 1385).

2. The sale will take place through the distribution network belonging to PGE Distribution SA as the Operator of the Distribution System, with which the contracting authority has concluded contracts (for individual facilities) for the provision of distribution services.

3. The Ordering Party has a power production concession No WEE/612/11621/W/3/2004/KG and produces electricity in a biogas power plant.

4. The Contractor is obliged to purchase the electricity introduced into the grid (under a separate sales and commercial balancing agreement) at a contractual price not lower than the average sale price of electricity on the competitive market in the previous quarter, announced by the President of the Energy Regulatory Office, referred to in Article 23(2)(18b) of the Energy Law.

5. The Contractor shall be responsible for the commercial balancing of electricity and shall relieve the Ordering Party from the obligations relating to imbalances.

6 In order to simplify the rules for accounting for active electricity consumption, the Ordering Party intends to achieve one fixed price per kilowatt hour in each tariff. Therefore

The offered unit price of electricity must include all additional costs and fees related to the implementation of the subject of the contract, including in particular fixed costs of commercial fees.

Task No. 2, tariff C12a - Management Building 76 Witosa Street - 20,000 MWh;

Task No. 3, tariff B11 - Landfill at 98 Witosa Street - 30,000 MWh;

Task No. 4, tariff C11 - "Old composting plant" Witosa 96 - 110,000 MWh;

Task No. 5, B23 tariff - Transport base 76 Witosa Street - 80,000 MWh;

Task No. 6, G12 tariff - Residential building of 10 Zielony Sztandaru Street - 10,000 MWh.
