3.1 The subject of the contract are services consisting in the protection of persons and property in the facilities of the Medical University of Lodz.
3.2 The service is described in the following appendices:
Annex 2 to the SWZ – Description of the subject of the contract
Annex 2.1 to the SWZ – Scope of protection and list of protected objects
Annexes 2.2 – 2.5 to the SWZ – Object Protection Instruction
3.3 The Contractor is obliged to perform the contract on the terms and conditions described in the contract template constituting Annex 4 to the SWZ.
3.4 The service shall be performed in the active facilities of the Ordering Party, in which, m.in didactic classes, scientific research, laboratory trowels, administrative work are carried out.
3.5 Due to the diversity of individual facilities, their specificity and nature, the Contractor may, before submitting the offer, familiarize himself with their location and specificity without organizing a site visit by the Contracting Authority.
The procedure is conducted in the form of an open tender pursuant to Articles 132-139 of the Public Procurement Law of 11 September 2019, hereinafter referred to as the "Public Procurement Law", taking into account the provisions applicable to contracts for social services, Article 359 point 1 (social services and other specific services with a value exceeding the equivalent of EUR 750,000). The estimated value of the contract exceeds the equivalent of EUR 750,000.
3.9.The contracting authority provides for the possibility of awarding contracts referred to in Article 214(1)(7) of the Public Procurement Law, constituting no more than 30% of the estimated contract value, consisting in the repetition of similar services for the protection of persons and property, specified in the contract documentation. Such a contract will be awarded on the basis of the relevant provisions of the PPL.
3.10 The Contracting Authority does not reserve the obligation of the Contractor to personally perform key parts of the contract.
3.11 The Contracting Authority requires that the activities related to the performance of this contract be performed by persons employed by the Contractor or its subcontractors on the basis of an employment relationship within the meaning of the provisions of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2022, item 1510) to the extent specified in the model contract, Annex 4 to the SWZ.
4.1 Term of the contract: 48 months from the date of signing the contract, but not earlier than from 1.02.2024.
