The subject of the contract is the performance of permanent and ad hoc, round-the-clock physical protection and electronic monitoring of persons and property in the building of the Ministry of Agriculture and Rural Development in Warsaw within the streets: Wspólna, Krucza, Parkingowa and Żurawia, in accordance with the "Facility Protection Plan of the Ministry of Agriculture and Rural Development". The service will be provided for a period of 24 months.

1. The subject of the contract is the performance of permanent and ad hoc, round-the-clock physical protection and electronic monitoring of persons and property in the building of the Ministry of Agriculture and Rural Development in Warsaw within the streets: Wspólna, Krucza, Parkingowa and Żurawia, in accordance with the "Facility Protection Plan of the Ministry of Agriculture and Rural Development". The service will be provided for a period of 24 months.

2. The contracting authority provides for the award of contracts referred to in Article 214(1)(7) of the PPL, i.e. the so-called "similar" contracts within the scope of up to 46,300 hours, but no longer than for a period of 9 months from the completion of the basic contract, consisting in the provision of a permanent, round-the-clock physical security service of the building of the Ministry of Agriculture and Rural Development at 30 Wspólna Street in Warsaw. The execution of a similar order will take place under the conditions set out in Annex 1 to the SWZ – OPZ and in the contract for the basic order concerning, m.in terms of remuneration rules (mechanism), contractual penalties, supervision over the performance of the contract. The award of a similar contract will be preceded by negotiations with the contractor of the basic contract regarding the amount of remuneration for its implementation.

3. The Contracting Authority shall not reserve the requirements related to the performance of the contract referred to in Article 94 of the PPL.

4. The contracting authority requires the contractor or subcontractor to employ persons referred to in Article 95 of the PPL Act on the basis of an employment relationship. This requirement applies to security personnel performing constant round-the-clock physical protection of persons and property. The requirement shall not apply to security personnel forming part of an intervention group. Details of the requirement of employment on the basis of an employment relationship are set out in § 8 of Annex 2 to the SWZ – Model contract.

5. The Contracting Authority provides for the on-site inspection and the possibility for the Contractors to inspect the documents necessary for the performance of the contract available on site at the Contracting Authority, referred to in Article 131 paragraph 2 of the PPL. The date of the on-site inspection is set for 12.06.2023 at 12:00, place: MRiRW building at 30 Wspólna Street in Warsaw. A maximum of 2 (two) persons on the Contractor's side may take part in the on-site inspection. At least 2 working days before the date of the inspection, the Contractor is obliged to report via e-mail to the following address: maciej.luniewski@minrol.gov.pl persons authorized by the Contractor to take part in the on-site inspection. To issue a pass entitling to enter the Ordering Party's headquarters, an identity document with a photo is required. In the case of access to documents containing classified information, the person representing the Contractor is required to present a certificate that will authorize access to information with the "restricted" clause.

6. The Contractor will perform the subject of the contract for a period of 24 months from the date of conclusion of the contract, but not earlier than from 21.12.2023.

7. The subject of the contract is not divided into parts. Bearing in mind the specificity of the subject of the contract, there is no justified need to divide the contract into lots. The subject of the contract takes into account the possibility of participation in the procedure of economic operators from the sector of small and medium-sized enterprises, which may result in increasing the competitiveness of contractors from the above-mentioned sector with large enterprises. In addition, the division of the contract into lots could cause technical difficulties and excessive costs of contract performance related to, m.in. the need to ensure the continuity of the service, the need to ensure safety and uniform responsibility for the functioning of the protected facility, the need to coordinate activities and arrangements performed by various Contractors.

8. A detailed description of the subject of the contract is attached as Appendix No. 1 to the SWZ.
