1. The subject of the contract is the supply to the Podkarpackie Voivodship Office in Rzeszów of computer equipment: computers, screen monitors and computer accessories under the project No. 1/14-2022 / OG-FAMI entitled "Increasing the standard of service for foreigners in the Podkarpackie Voivodeship in the realities of military operations in Ukraine" co-financed from the National Programme of the Asylum, Migration and Integration Fund and the state budget. 2. A detailed description of the subject and conditions of the contract are described in the SWZ Part A, Part B - Description of the subject of the contract - technical specification and Part C - Draft provisions of the contract. 3. The procedure is conducted in an open tender procedure pursuant to the Act of 11 September 2019 – Public Procurement Law (Journal of Laws of 2022, item 1710, as amended), hereinafter referred to as "uPzp" and SWZ. 4. The contracting authority provides for the application of the so-called reverse procedure referred to in Article 139(1) of the PPL, i.e. the contracting authority will first examine and evaluate the bids, and then make the subjective qualification of the Contractor whose bid was rated the highest in terms of the lack of grounds for exclusion and meeting the conditions for participation in the procedure. 5. Pursuant to Article 310(1) of the PPL, the Contracting Authority provides for the possibility of cancelling the procedure in question if the funds that the Contracting Authority intended to allocate to finance all or part of the contract have not been granted to it. 6. The Contractor shall be excluded from the procurement procedure on the basis of: a) Article 108(1) and Article 109(1)(2), (4)-(9) of the PPL, b) Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving the protection of national security (Journal of Laws, item 835), (c) Article 5k of Council Regulation (EU) No 833/2014 of 31 July 2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine. EU No L 229, 31.7.2014, p. 1), as amended by Council Regulation (EU) 2022/576 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia's actions destabilising the situation in Ukraine (OJ L 229, p. 1). EU No L 111, 8.4.2022, p. 1) 7. The Contractor is obliged to attach to the bid a statement valid as at the date of submission of tenders that it is not subject to exclusion and meets the conditions for participation in the proceedings. in the form of: a) the European Single Procurement Document – Annex 1 to the SWZ; b) a statement on the absence of grounds for exclusion referred to in paragraph 6 letters b and c – Annex 2 to the SWZ. 8. In order to confirm the absence of grounds for excluding the Contractor from participation in the proceedings and meeting the conditions for participation in the proceedings, the Contracting Authority shall request subjective means of evidence specified in the SWZ. 9. The Contracting Authority requests that the proof necessary to conduct the proceedings be submitted together with the offer to confirm that the offered supplies meet the requirements, characteristics or criteria specified by the Contracting entity – in accordance with the requirements set out in the SWZ. 10. Detailed information on subjective and subject means of evidence as well as documents and statements submitted by Contractors, Contractors / persons having their registered office or place of residence outside the territory of the Republic of Poland, Contractors jointly applying for the award of the contract can be found in the SWZ. 11. The Contracting Authority does not provide for an electronic auction. 12. The Contracting Authority does not provide for submitting an offer in the form of electronic catalogues. 13. The Contracting Authority shall not conduct proceedings for the conclusion of a framework agreement. 14. The Contracting Authority shall not reserve the right to apply for the award of a contract only by the Contractors referred to in Article 94 of the PPL. 15. The contracting authority shall not specify additional requirements related to the employment of persons referred to in Article 96(2)(2) of the PPL. 16.
