The procedure is conducted under the open tender procedure pursuant to Article 129(1)(1) in conjunction with Article 129(2) and Articles 132-139 of the Act of 11 September 2019. Public Procurement Law (consolidated text: Journal of Laws of 2022, item 1710, as amended - "PZP") and implementing acts to the Pzp.
The proceedings shall be carried out in accordance with the rules laid down for classical procurement with a value equal to or exceeding the Union thresholds.
Package 1 – Forestry: Miszewo and GlewnikThe material scope of the subject of the contract includes the total amount of works in the field of forest breeding and protection, fire protection, tourist development, harvesting and harvesting of wood as well as hunting and meadow-agricultural management resulting from Annex 2 to the SWZ. Package 8 – Hunting economy region 125The material scope of the subject of the contract includes the total amount of works in the field of forest breeding and protection, fire protection, tourist development, harvesting and harvesting of wood as well as hunting and meadow-agricultural management resulting from Annex 2 to the SWZ. The material scopes listed in the annexes included in Annex 2 are estimates.
The implementation of works included in the subject of the contract for individual Packages will take place in the area of forests – appropriate for a given Package ("Package Implementation Area"). The location (forest address) of individual forest works falling within the scope of the Subject of the Agreement indicated in the annexes included in Annex 2 is preliminary. The location (forest address) of individual works falling within the scope of the Subject of the Agreement will be specified in the Order referred to in point 3.3. point 1), with the proviso that it will always be the Package Implementation Area.
In view of the actual natural weather situation that may occur during the execution of the subject of the contract, as well as the economic and economic situation unforeseen at the moment, the Contracting Authority reserves the right to make reductive adjustments, enhancement adjustments, new location, as well as pausing the steps indicated in each line of tables describing the subject of the order. Increasing adjustments do not imply the introduction of new works, not covered by the scope of the contract, and reductive adjustments do not imply a complete abandonment of part They should be understood as increasing the amount of work in one location (forest address) in the Package Implementation Area (including locations in the Package Implementation Area not pre-indicated in the SWZ), while reducing the amount of work in another location (forest address) on Package Implementation Area, within the total quantities of individual work falling within the scope of the Contract Subject as defined in the SWZ, to be carried out throughout the Package Implementation Area. The need to increase the size of certain elements of the procurement in the course of the performance of the contract subject may also occur in order to complete the full range of works described in the subject matter of the contract. Establishing a new location is carried out within the subject of the order, always only in the Package Redeemment Area.
The Ordering Party does not reserve the obligation of the Contractor to personally perform key tasks regarding the subject of the contract. The Contractor may entrust the implementation of elements (parts) of the subject of the contract to subcontractors. In the case of an intention to perform the subject of the contract with the participation of subcontractors, the contractor is obliged to indicate in its tender the part of the contract (material scopes), the performance of which it intends to entrust to subcontractors, and to provide the names of possible subcontractors, if they are already known. Such an indication should be placed on the Offer.
The Contracting Authority in accordance with Article 95 of the PZP shall require employment by the Contractor or subcontractor on the basis of the working relationship of persons performing the performance of the contract consisting of:
Package 1-6: harvesting and harvesting wood raw material,
Package 7-8: transport of hunters (agricultural tractor operator),
Package 9-10: mowing meadows (agricultural tractor operator),
if the performance of these activities consists in performing work in the manner specified in article 22 § 1 of the Act of 26 June 1974 - Labour Code (consolidated text: Journal of Laws of 2022, item 1150, as amended)
In relation to each Package, the Ordering Party is entitled to commission the Contractor with an additional material scope in relation to the total number of all activities valued in each of the items of the offer estimate constituting part of the Offer ("Option"). Works subject to the Option may be commissioned in an amount that will not exceed 20% of the Value of the Subject of the Agreement.
