1. The subject-matter of the present proceedings is the supply of electricity to the buildings of the Władysław Strzemiński Academy of Fine Arts in Łódź.
2. A detailed description of the subject of the contract is specified in Annex 1a to the SWZ.
3. The economic operator may submit a single tender. To be valid, the tender must include all the items described in Annexes 1a and 1aa.
4. The description of the subject of the contract should be read together with any changes in the content of the specification, resulting from the answers to contractors' inquiries.
5. All the requirements set out in the documents indicated above are minimum requirements and their fulfillment is obligatory. Failure to meet the above-mentioned minimum requirements will result in the rejection of the tender as inconsistent with the terms of the contract pursuant to Article 226(1)(5) of the PPL.
6. The total estimated demand for electricity supply in the term of the contract is: 1,000 MWh.

7. The given value of demand is an estimated value and in a situation where the actual consumption will be lower than estimated, and the difference between these values does not exceed 10% of the volume described in paragraph 2 during the contract completion period, the Contractor will not claim any claims in this respect and the settlement will be based on the amount of actual consumption at the rates offered in the offer of energy prices constituting the basis for the conclusion of this contract.
8.Under the option right, the Ordering Party provides for the possibility of increasing the amount of electricity sold by 10% in relation to the volume described in paragraph 6. In this case, the settlement of energy supplied under the option right will take place on the basis of the rates offered in the offer of energy prices constituting the basis for the conclusion of this contract. If the Ordering Party exercises the right of option, to the rights and obligations of the Ordering Party and the Contractor, the provisions of this contract shall apply in full. The exercise of the right of option does not require an annex to the contract. If the Ordering Party exercises the option right, the basis for calculating contractual penalties will be the sum of the remuneration indicated in the contract and the remuneration under the option right, respectively.
9. The Contractor will carry out settlements for the energy consumed in accordance with the settlement periods applied by the DSOs, based on the measurement data received from the DSO.
10. The Contractor declares that it has concluded a general distribution agreement with DSOs to whose network the PPE of the End User is connected.
11. The Ordering Party declares that it has the legal right to use the facilities to which electricity is to be supplied under the Agreement.
