“Modernization and reconstruction of an alternative system for the main communication axis in Dąbrowa Górnicza”

— construction in the system “design and build” road connecting Konopnicka Street and Poniatowskiego Street with Zagłębia Dąbrowskiego Avenue

1. The scope of works includes the design and construction of:

a. municipal road with a length of approx. 900m (extension of Kolejowa Street),

b. reconstruction of the "roundabout" intersection of Konopnicka, Kolejowa and Poniatowskiego streets,

c. a roundabout type intersection enabling the connection of Poniatowskiego streets, the section from the intersection of Konopnicka and Kolejowa with the newly built section,

d. construction and/or reconstruction of infrastructure for pedestrians and cyclists along the section in question (from Kolejowa Street to Graniczna Street (passage under the railway tracks),

e. reconstruction of the road viaduct along Cupiala Street, to the extent necessary to make a road connection by making a road embankment parallel to the existing railway tracks and making the intersection of Graniczna / Cupiała Street with the extension of Kolejowa Street,

f. reconstruction of roads other than those indicated above in order to restore damaged road connections or ensure access to the property,

g. drainage system (receiver with pumping station), which will ensure drainage of water from the sidewalk and bicycle path carrying traffic to the area of the underground passage along Konopnicka Street from Poniatowskiego Street.

2. The order will be implemented on the basis of:

2.1.tender specifications,

2.2. provisions contained in the content of the future contract,

2.3. functional and utility program - Annex 8 to the SWZ.

3. The contract must be performed in accordance with:

a. By the Law of 20 June 1997. Road Traffic Law (Journal of Laws of 2022, item 988, as amended).

b. Act of 21 March 1985 on public roads (Journal of Laws of 2022, item 1693, as amended).

c. the Regulation of the Minister of Infrastructure of 23 September 2003 on the detailed conditions for traffic management on roads and the exercise of supervision over this ordinance (Journal of Laws of 2020, item 470, as amended).

d. Regulation of the Minister of Infrastructure of 3 July 2003 on detailed technical conditions for road signs and signals as well as road safety devices and conditions for placing on roads (Journal of Laws of 2019, item 2311, as amended).

e. Act of 7 July 1994, Construction Law (Journal of Laws of 2021, item 2351, as amended).

4. Pursuant to Article 257 of the PPL, the contracting authority reserves the right to cancel the public procurement procedure if the funds it intends to allocate to financing

all or part of the contract has not been awarded to him.

Equivalent solutions

3.1. If the Contracting Authority has indicated trademarks, patents or origin in the description of the subject of the contract, sources or a specific process which characterizes the products or services provided by a particular contractor, it is permitted to offer equivalent solutions to those described, provided that the by not the same minimum technical, qualitative and functional parameters, etc.

3.2. The Contractor who invokes equivalent solutions shall demonstrate that the solution offered by him meets the requirements laid down by the contracting authority. In this case, the contractor shall attach to the offer a list of equivalent solutions together with its description or standards.

3.3. Where references to standards, technical assessments, technical specifications and technical reference systems referred to in Article 101 (1) (2) and paragraph 3 of the Pzp Act, the Contracting Authority shall allow solutions equivalent to those described.

3.4. Wherever specific standards and regulations are referred to in tender documents to be met by materials, equipment and other goods and works carried out and examined, the provisions of the most recent edition or revised edition of the said standards and regulations shall apply, unless otherwise provided in the terms of the contract.
