1. The subject of this contract is a comprehensive supply of electricity to the facilities listed in Annex 1 to the SWZ – description of the subject of the contract. The electricity demand in the period from 01.03.2023 to 31.12.2023 is: 961 290 kWh (basic order). 2. The detailed scope of the contract is specified in Annex 1 to the SWZ, in accordance with the provisions of the Energy Law Act of 10 April 1997. Other conditions regarding the execution of the contract are set out in the Draft provisions of the electricity sale agreement – Annex No. 2 to the SWZ. 3. Comprehensive supply of electricity will take place under the conditions specified in the provisions of the Act of 10 April 1997 – Energy Law, the Act of 8 December 2017 on the capacity market and in accordance with the implementing regulations issued to these acts, in particular with the customer service quality standards set out in the Regulation of the Minister of Climate and Environment of 5 January 2022 amending the Regulation on the detailed rules for shaping and calculating tariffs, and settlements in electricity trading and the Regulation of the Minister of Climate and Environment of 11 November 2020 amending the Regulation on the detailed conditions for the operation of the power system 4. The reserve seller is: Enea S.A. 5. The requirements (obligations) for the Contractor are described in the Draft provisions of the contract, constituting Annex 2 to the SWZ. The Contracting Authority shall grant the Contractor selected in the proceedings a power of attorney. 6. Annex 1 of the SWZ provides information on current parameters (tariff group/contractual capacities) that may be subject to change during the term of the electricity contract. 7. In the course of the contract, the Ordering Party reserves the right to reduce or increase the value of the contract to the extent of +/-30% in relation to the value of the basic order. 8. The increase in the value of the contract will take place on the basis of the right of option. The rules, scope and manner of exercising the option right by the Ordering Party are described in Section I, section 2 point 3 of the Draft provisions of the contract (according to the template constituting Annex 2 to the SWZ). 9. The value of the contract will be reduced on the basis, to the extent and manner described in Section I, paragraph 2, point 4 of the Draft provisions of the contract (according to the template constituting Annex 2 to the SWZ). 10. The Ordering Party has the right, during the term of the Agreement, to change tariff groups, the contractual force for individual PPE specified in Annex 1 to the Agreement after prior agreement with the Distribution System Operator, hereinafter referred to as DSOs. Amendments to the Agreement shall take place upon a written notification of the Contracting Authority to the Contractor, starting from the DSO's making the change. The above changes will be carried out on the terms set out in the tariff of the distribution system operator appropriate for the Ordering Party and will concern, in particular, ensuring proper functioning of a given facility (in accordance with its intended purpose) and/or reducing costs on the distribution service. 11. The contracting authority does not provide for partial tenders for individual PPEs. 12. For details, see Chapter IV.
