1. The subject matter of the proceedings is "Comprehensive supply of electricity and provision of electricity distribution services for the Tarnowo Podgórne commune, organizational units of the Tarnowo Podgórne Commune, cultural institutions and municipal companies in 2020-2021".
2. The Contractor is obliged to fulfill the subject of the order on terms including the Essential Provisions of the Agreement, which constitute Attachments No. 7 and Annex No. 8 to the ToR.
1. Comprehensive supply of electricity and the provision of electricity distribution services will take place in accordance with the applicable law, in particular on the conditions set out in the Act of 10 April 1997 - Energy Law (Journal of Laws of 2019, item 755, as amended), implementing regulations to this act, in particular the Regulation of the Minister of Economy of 4 May 2007 on detailed conditions for the operation of the power system (Journal of Laws of 2007 No. 93, item 623, as amended) and the Regulation of the Minister of Energy of 6 March 2019 on detailed rules for the formation and calculation of tariffs and settlements in electricity trade (Journal of Laws of 2019, item 503), Tariffs for electricity distribution services (OSD tariff) and The Distribution Network Operation and Maintenance Manual (IRiESD) of the relevant Distribution System Operator, ie Enea Operator Sp. z oo, ul. Strzeszyńska 58, 60-479 Poznań.
2. The object of the contract includes the supply of electricity and the provision of electricity distribution services in the planned quantity of 22,373,128 kWh from 1 January 2020 to December 31, 2021 (24 months) to electricity consumption points according to Annex No. 1 to SIWZ.
3. A detailed description of the subject of the order along with the list of electricity consumption points for individual parts of the subject of the contract is contained in Annex No. 1 to the Terms of Reference, respectively. Declared in the above the electricity consumption is an estimated value and is used only to estimate the value of the order and calculate the offer price.
4. This order covers the supply of electricity and the provision of electricity distribution services.
5. The Contractor will provide active electricity in accordance with the applicable quality standards of customer service, specified in the executive acts issued on the basis of the Act of 10 April 1997 - Energy Law (Journal of Laws of 2019 item 755, as amended) .
6. The Purchaser informs that within the subject of the contract, the Contractor is responsible for commercial balancing and must have the status of Responsible Entity for Commercial Balancing (so-called POB).
ATTENTION!
The entity responsible for commercial balancing must be entered on the POB list at a given Distribution System Operator as at the offer submission date.
7. The Ordering Party under this contract provides for the option to exercise the right of option, in the circumstances and dates referred to below:
In the course of the contract performance, the Ordering Party reserves the right to increase by 3 355,970 kWh the total amount of energy specified in Chapter 3 points. 4 SIWZ.
