The project, as better described in the tender documents, must be drawn up in the manner and documentation provided for in art. 41-44 and Annex I.7, art. 41 paragraph 15 and Annex I.13 of Legislative Decree 36/2023 as well as on the basis of the technical documentation relating to the approved PFTE and as established in the Tender Notice and Regulations. The design will be divided into two phases: the 1st will consist of an update to the PFTE currently carried out and approved according to the old Code 50/2016 and which will be updated with the documents referred to in Annex I.13 of Legislative Decree 36/2023; The aforementioned documents will constitute the prerequisite for the request for opinions and acts of consent, and for the start of expropriation procedures. The 2nd consists of the Executive Project, as described in the Code.
The contract consists in the assignment of the updating services of the technical-economic feasibility project pursuant to the new code of public contracts Legislative Decree 36/2023, executive design, coordination in the field of health and safety in the design phase, with the option of awarding the services of Works Management and CSE, for the construction of the new Virgilio Art School in Via Raffaello Sanzio in Empoli. The basic consideration is € 1,247,161.88, net of social security and welfare charges and VAT, calculated on the basis of an amount of € 20,520,000.00 divided into the following categories ID:Works:E.09 € 3,553,001.05, S.04 € 10,944,030.80, IA.01 € 559,643.00, IA.02 € 2,523,387.71, IA.03 € 2,272,332.00, V.02 € 667,605.44. Pursuant to art. 119 paragraph 2 of Legislative Decree 36/2023 the contractor cannot make use of subcontracting except for geological, geotechnical and seismic investigations, surveys, surveys, measurements and staking, preparation of specialized and detailed documents, with the exclusion of geological reports, as well as only for the graphic drafting of the project documents. The contractor must also directly perform the part of the service related to project information management and BIM modeling. The designer may entrust to third parties specialized consultancy activities relating to the energy, environmental, acoustic and other sectors not related to the engineering and architectural disciplines for which specific certifications or skills are required, without prejudice to the responsibility of the designer also for the purposes of these activities. However, the exclusive responsibility of the designer remains.
