4.1 The subject of these proceedings are services consisting in round-the-clock removal of the effects of accidents and road incidents occurring in the City of Łódź. The scope of the contract includes, m.in: ongoing road maintenance, consisting in removing the effects of accidents and road incidents due to the improvement of traffic safety, reducing the possibility of collision or skidding of vehicles on the locally excluded roadway or pedestrian route.

The scope of the contract includes, m.in: ongoing road maintenance, consisting in removing the effects of accidents and road incidents due to the improvement of traffic safety, reducing the possibility of collision or skidding of vehicles on the locally excluded roadway or pedestrian route.

4.3 The order has not been divided into parts. The contracting authority withdrew from dividing the contract into lots, due to the fact that the contract is a uniform whole and interconnections between individual scopes for technical, organizational and economic reasons. Dividing into parts would negatively affect safety by extending the lead time in crisis situations. Failure to divide the contract into lots will not violate the principle of fair competition and will not limit the possibility of applying for the contract for smaller entities. Contractors belonging to SMEs will have no difficulty in implementing it as a whole.
4.4 Pursuant to Article 95 of the PPL, the Contracting Authority requires the Contractor or Subcontractor to employ persons on the basis of an employment contract to perform the activities indicated by the Contracting Authority in the scope of contract performance, if the performance of these activities consists in performing work in the manner specified in Article 22 §1 of the Act of 26 June 1974 – Labour Code (Journal of Laws of 2019, item 1040, as amended), i.e.:
The Contracting Authority requires that all activities consisting in the actual performance of services consisting in cleaning up after road accidents, unless they are (will be) performed by a given person as part of his business activity, be performed by persons employed by the Contractor or subcontractor on the basis of an employment contract within the meaning of the Act – Labour Code (indicate activities that consist in performing work in the manner specified in Article 22 § 1 of the Labour Code).
The scope of work of persons performing the activities indicated by the Contracting Authority in the field of contract performance and the method of documenting the employment of these persons and the Ordering Party's rights to control the Contractor's compliance with the requirements and sanctions for non-compliance with them are specified in the description of the subject of the contract (Annex No. 1 to the SWZ) and in the contract template (Annex No. 6 to the SWZ).
The contractor whose bid has been selected is obliged to lodge a performance bond in the amount of 4% of the total gross price specified in the offer.
Deadline for contract performance: from the date of conclusion of the contract, but not earlier than from 01.01.2023. until 31.12.2024
