The TFM+ model is intended to transfer comprehensive services of technical facility management, i.e. repair and maintenance, energy consumption volume management and property management and documentation to a private contractor (AN).
BLB NRW (client, AG) strives to achieve the following goals with the TFM+ model and the transfer of comprehensive services of coordination, control and realization to an individual contractual partner, among others:
— reduction of existing repair needs,
— increase the quality of the building,
— ensuring customer satisfaction,
— economic project realization through the integration of private sector know-how.
The subject of service provision is the following objects or economic entities (WE):
— Gelsenkirchen police headquarters (WE 1458).
Services of technical facility management:
The contractor must take over the services of technical facility or building management for a period of 10 years. This includes the following services:
— Object management:
—— object management,
— external company coordination,
— warranty tracking,
— Reporting:
—— operational management,
— position of operations officers,
— property inspection and traffic safety,
— energy management and controlling,
— maintenance, inspections and knowledgeable checks,
— expert reviews,
— Implementation of actions:
—— repairs and complete replacement of components,
—— beauty repairs (retrieval performance),
—— modernization measures (optional service),
—— measures to improve the energy efficiency of real estate (optional service)
—— improvements and modernizations that were not recognizable when the contract was concluded,
— incident/emergency management/acceptance of defects,
— elimination of vandalism damage,
— exemption from persons,
— creation and maintenance BIM model (optional performance),
— Contact person/on-call.
Technical facility management services may include improvement and modernization services.
The services are transferred to the AN based on the inventory documentation provided with the procurement documents (request for quotation). In addition, he is given the opportunity to commit the properties and request further investigations from the AG as part of the procurement process.
The AG bears risks that the contractor could not have identified as a knowledgeable third party prior to the conclusion of the contract due to the tender documents and the possibilities presented by the AN, in particular, risks arising from unforeseeable requirements of the responsible monument protection authority.
With the complete procurement documents, the bidder receives a part-related classification of the object into state classes:
— state class 1: required condition,
— condition class 2: slight defect,
— state class 3: medium shortage,
— State class 4: serious defect.
The condition classes form the basis of both the performance definition (improvement to condition class 1 within a period specified by the AG) and the Malus system (non-compliance with reaction and remediation times in case of deterioration).
Beauty repairs are to be offered by the AN as retrieval services based on the EP catalog of the standard service book.
Supply contracts are concluded by the AG. The TFM+ contract provides for a guarantee of consumption in order to ensure that the AN must represent additional consumption compared to the average consumption volumes of previous years. If energy measures are planned, the AN can offer a savings guarantee.
In order to implement the energy management concept, it may be necessary to set up additional meters. The scope of services may also include the installation of photovoltaic systems.
The AG transfers operator responsibility for the buildings, building parts and land areas to the AN, including the technical facilities listed in the functional specification of work and any other components, if applicable, unless the obligations covered by them expressly remain with the AG. Operator obligations are determined by Directive 190 of the German Association for Facility Management (GEFMA 190). Consequently, the parties consider the responsibility of the AN the AN the obligation and authorization of the AN to act independently for the purpose of fulfilling its duties.
The contractor bears the traffic safety obligation for the contract object unless the AG has again assumed the duty of road safety in the context of commissioning third parties, e.g. for carrying out cleaning services.
