The BBR is looking for suitable offices for the conclusion of a framework agreement on planning services in the field of object planning for buildings in accordance with § 34 HOAI for simple construction measures in accordance with Section D of the RBBau of Pool 01 Supreme Federal Authorities in Berlin.

The construction tasks include renovations as well as repairs or maintenance of parts of the building as well as smaller new construction measures. Some measures are implemented during ongoing operations. Some of the buildings are listed and some contain special uses with a representative character. The cost figures per individual measure are expected to be between EUR 150,000 and EUR 6 million (net). According to current estimates, the total cost volume (KG 100-700) of all tree measures amounts to approx. EUR 31 million (net).
The necessary services are to be awarded in a framework agreement with several offices. In principle, the contracts for the respective construction measures are to be awarded as individual contracts to a partner in the framework agreement.
The Federal Office for Building and Regional Planning conducts the award procedure as a negotiated procedure with a public call for participation in accordance with the regulations of the VgV in 2 stages:
- Stage 1: Participation Competition
- Stage 2: Negotiation of the framework agreement
As a result of the award procedure, up to 10 framework agreement partners are to be available.
The decision on the object-specific award (stage 3 - individual commissioning) of the planning services is made by means of a renewed call for price competition between all economic operators who are parties to the framework agreement.
In the case of estimated estimated eligible costs of the object planning of buildings and interiors of € ≥ 500,000 as well as an increased degree of complexity of the specific construction measure, further award criteria and minimum requirements for the project team apply in addition to the price, see III.1.3) Project team. After an additional interview, the evaluation is carried out according to the award criteria, which are named in the evaluation matrix level 3.
The expected individual orders include planning services in the field of building planning in accordance with § 34 HOAI, service phases 1-9 as well as special services.
The exact scope of services is determined in the individual order (level 3 - object-specific). The object-specific individual order is carried out in stages in the five service levels described in section 4.2 of the framework agreement. There is no legal entitlement - after the transfer of a service level - to the transfer of subsequent service levels or parts thereof. The client also reserves the right to limit the transfer of further services to individual sections of the construction project or individual service areas.
The start of the framework agreement period is approx. 02/2024.
The commissioning of the planning services (object-specific) is planned for the years 2024 to 2028. The duration of the individual contracts based on the framework agreement (object-specific) may extend beyond the term of the framework agreement.
In the case of framework agreements, maximum value over the entire term: EUR 3,611,000.00 net or EUR 4,297,100.00 gross
The processing of individual projects requires the successful verification of level Ü2 according to the Security Clearance Act (§ 9 SÜG) for a person involved in planning and construction or level Ü2 according to sabotage protection (§ 9 para. 1 no. 3 SÜG) for all persons with access authorization to the construction sites and existing buildings. Insofar as the employees entrusted with the execution of the contract have not yet been successfully checked at level Ü 2, it is sufficient for the award procedure if a corresponding declaration is signed that there is a willingness to carry out a corresponding security check on the specified employees. However, it is clarified that the conclusion of the framework agreement and the resulting individual orders are only concluded under condition in accordance with § 158 BGB that the verification of level Ü 2 can be successfully completed or that a successfully completed security check is not revoked.
