Description:
Improvement of spatial mobility of Wielkopolska residents in public transport through the purchase of new rolling stock

The subject of the contract is the delivery of 8 (in words: eight) pieces of brand new, electric multiple units to service electrified routes as part of the regional regional rail transport along with:

- providing technical instructions in the field of operation and maintenance of vehicles to persons

indicated by the Ordering Party;

- granting a guarantee and extended warranty for the delivered vehicles;

- preparation and transmission of technical documentation;

- licensing of technical documentation and software.

A detailed description of the subject matter of the contract is set out in the Description of the subject of the contract, annex 1 to the SWZ and in the Annexes to the OPZ and in the proposed provisions of the contract annex 3 to the SWZ.

I. The subject of the contract is the delivery of 8 (in words: eight) pieces of brand new, electric multiple units to service electrified routes as part of the regional regional rail transport together with:

- providing technical instructions in the field of operation and maintenance of vehicles to persons

indicated by the Ordering Party;

- granting a guarantee and extended warranty for the delivered vehicles;

- preparation and transmission of technical documentation;

- licensing of technical documentation and software.

The subject of the Order will be implemented with European Union funds under the National Recovery and Resilience Plan and must comply with the DNSH principle (Do No Significant Harm). The solutions used should comply with each of the six environmental objectives of the DNSH principle:

1. Mitigating climate change;

2. Adaptation to climate change;

3. Appropriate use and protection of water and marine resources;

4. Circular economy, including waste prevention and recycling;

5. Prevention and control of air, water or land pollution;

6. Protection and restoration of biodiversity and ecosystems.

A detailed description of the subject of the contract is set out in the OPZ constituting Annex 1 to the SWZ and in the annexes to the OPZ and in the draft provisions of the contract constituting Annex 3 to the SWZ.

II. GDPR - according to point 25 SWZ.

III. The Contractor is obliged to provide a security for the proper performance of the contract - point 23 of the SWZ.

IV. Grounds for exclusion other than those listed in Section III.1.2) of the notice.

1. Pursuant to Article 7(1) of the Act of 13 April 2022 on special solutions for counteracting support for aggression against Ukraine and serving to protect national security (Journal of Laws of 2023, item 129, as amended), the following shall be excluded from the public procurement procedure conducted on the basis of the PPL:

1) an economic operator included in the lists set out in Regulation 765/2006 and Regulation 269/2014 or entered on the list on the basis of a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the Act;

2) a contractor whose beneficial owner within the meaning of the Act of 1 March 2018 on counteracting money laundering and terrorist financing (Journal of Laws of 2022, item 593, as amended) is a person listed in the lists specified in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a beneficial owner from 24 February 2022, if it has been entered on the list on the basis of a decision on entry on the list determining the application of the measure referred to in Article 1(3) of the Act;

3) a contractor whose parent company within the meaning of Article 3(1)(37) of the Accounting Act of 29 September 1994 (Journal of Laws of 2023, item 120, as amended) is an entity listed in Regulation 765/2006 and Regulation 269/2014 or entered on the list or being such a parent company from 24 February 2022, provided that he was entered on the list on the basis of a decision on entry on the list deciding on the application of the measure referred to in Article 1(3) of the Act.

2. In the case of a contractor excluded on the basis referred to in point 1, the contracting authority shall reject the offer of such a contractor.

3. Applying for the award of a public contract shall mean the submission of a tender.

4. A person or entity subject to exclusion pursuant to point 1 which, during the period of such exclusion, applies for the award of a public contract or participates in a public procurement procedure shall be subject to a financial penalty referred to in Article 7(7) of the Act on special arrangements for counteracting the promotion of aggression against Ukraine and for the protection of national security.
