The order was divided into two parts:
1) Part 1 – Publications, brochures, leaflets
2) Part 2 - Notebooks
The scope of the above-mentioned parts is specified in Annex 1 to the offer form (publications, brochures, leaflets, etc.) and Annex 2 to the offer form (notebooks), i.e. in the detailed specification of individual items delivered to the Educational Research Institute or to another indicated place in the Polish.
As a result of this procedure, 2 framework agreements will be concluded (separately with regard to lot 1 and part 2), on the basis of which executive agreements will be concluded (executive contracts awarded) between the Contracting Authority and the Contractor selected for its conclusion.

The subject of the contract is implemented as part of a project co-financed by the European Union from the European Social Fund, under the Operational Programme Knowledge Education Development:
Supporting the functioning and improvement of the IQS for the use of the solutions offered in it to achieve the objectives of the national development strategy - IQS 5
and other projects conducted by the Educational Research Institute.
As a result of this procedure, 2 framework agreements will be concluded (separately with respect to lot 1 and part 2), on the basis of which executive agreements will be concluded (executive contracts awarded) between the Contracting Authority and the Contractor selected for its conclusion pursuant to Article 311(1)(1) of the PPL Act and in accordance with
with the procedure specified in framework agreements, i.e. by asking for the submission of tenders where not all the conditions for the provision of services or not all the conditions for selecting Contractors who are party to framework agreements are specified in the framework agreements.
The Contracting Authority will conclude 2 framework agreements (a framework agreement for lot 1 will be concluded with a maximum of 3 Contractors, a framework agreement for lot 2 will be concluded with a maximum of 1 Contractor).
For Lot 1 only:
If fewer than 3 contractors submit non-rejected bids, the Contracting Authority shall conclude framework agreements with all contractors who submit non-rejected bids. If more than 3 contractors submit non-rejected bids, the Contracting Authority shall conclude framework agreements with 3 contractors who will receive the highest number of points in the ranking as part of the evaluation of tenders. In a situation where there is more than one contractor selected in the last 3rd place, framework agreements will be concluded with more than 3 contractors.
On the basis of framework agreements, the Contracting Authority shall address the Contractors,
with whom it will conclude framework agreements with an invitation to submit tenders for the printing of publications issued by the Educational Research Institute in the period from the date of signing the framework agreements to 31 December 2024. As part of the inquiry, it will indicate information on the technical specification, the date of submitting files for printing, the expected delivery date in accordance with the procedure contained in the draft executive agreement (Annex 6.2. to the SWZ).
Execution contracts will be awarded to the Contractor selected to conclude an executive agreement (award of an executive contract) pursuant to Article 314(1)(2) of the PPL, i.e. before awarding each contract, the contracting authority shall invite contractors capable of performing a specific contract in writing to submit tenders, set a deadline for submitting tenders, taking into account the complexity of the subject of the contract and the time necessary to prepare and submit tenders for each contract. Bids shall be submitted by means of electronic communication within a period of not less than 3 days. The contracting authority shall award the contract to the contractor submitting the most advantageous tender on the basis of the tender evaluation criteria specified in the invitation to tender.

For Part 2 only:
Contractors will be awarded to the Contractor selected to conclude an executive agreement (award of an executive contract) pursuant to Article 313(2) of the PPL, i.e. if not all conditions for the performance of services or supplies are specified in the framework agreement, the contracting authority may request the contractor in writing to supplement the bid before awarding each contract. Otherwise, the Contracting Authority shall use the option provided for in paragraph 1 of the above-mentioned article and award the contract without conducting a contract award.
