4.2.The subject of the contract should meet the quality requirements set out in the Regulation of the Minister of Economy of 9 October 2015 on quality requirements for liquid fuels (Journal of Laws of 2015, item 1680, as amended) and the requirements set out in PN-EN 590:2013-12, PN-EN 228:2013-04 The offer should be accompanied by the results of tests of the offered diesel oil carried out by an independent laboratory accredited by the Polish Centre for Accreditation authorized to conduct oil tests. The test results must confirm that the diesel fuel offered meets the minimum conditions set out above.

4.3.Conditions for implementation:
1. Delivery of the subject of the order with an estimated total quantity of:
- 220m3 – diesel
- 20 m3 – heating oil
2. One-stop delivery will be:
a) for diesel oil - approx. 4-5 m3
b) for heating oil – approx. 2-3 m3
3. Transport of the subject of the contract carried out entirely by the Contractor - without the participation of the Ordering Party. All means of transport of the Contractor should be equipped with a legalized measuring device determining the amount of diesel oil in liters and meeting the technical conditions for the transport of liquid fuels, specified in the relevant provisions of law.
4. Delivery of the subject of the order within 48 hours from the moment of placing a telephone, fax or written request. Due to the strategic nature of the contract, a delay in delivery not preceded by appropriate agreements between the parties will inevitably result in the calculation of contractual penalties specified in the draft contract, and in the case of repeated deficiencies, also in the termination of the contract due to the fault of the Contractor. The above requirement will be treated rigorously by the Contracting Authority.
5. The requirement for the Contractor to notify a strict delivery date (day and approximate time). The Ordering Party will accept deliveries between 700 and 1400 on working days (Mon-Friday). Failure to comply with this daily deadline will be treated as a delay in delivery. Fuel collection at other hours than 700 – 1400 is permissible after agreement with the Ordering Party.
6. The Ordering Party reserves the right to purchase a total of less diesel oil than specified in paragraph 1, if it results from a lower than estimated demand.
4.4. Conditions for receipt of the task:
1. The subject of delivery will meet the requirements of the Ordering Party specified in point 4 of the Terms of Reference. This condition applies to any delivery of diesel fuel during the lead time.
2. Collection of each batch of the subject of delivery will take place at the Ordering Party's base located in the Municipal Waste Disposal Plant in Janczyce, 27-552 Baćkowice.
3. Collection of each batch of the subject of delivery will be carried out on the part of the Ordering Party only by persons designated for this purpose, i.e. Ms. Ewa Szydlak, Ms. Agnieszka Łaskawiec.
4. Partial deliveries of diesel fuel will be invoiced in m3.
5. The supplier is obliged to submit for each delivered batch of the subject of delivery on the day of its receipt:
1) attestation (or quality certificate, etc.) and proof of fuel filling,
2) at the request of the Ordering Party, the document of legalization of the tanker's measuring devices for inspection.
