educational institutions and organizational units for the needs of operating buildings, premises and utility facilities in the Municipality of Żory. The scope of the contract includes the supply of gaseous fuel for 52 points. The amount of gas supplied during the term of the contract is approx. 5 291.17 MWh.

Part 2

Nowe Miasto company for the purpose of operating buildings, premises and facilities used by it. The scope of the contract includes the supply of gaseous fuel for 15 points. The amount of gas supplied during the contract execution period is: approx. 2 240.00 MWh.

The order contains: tender documentation. Part 1: a) The scope of the contract includes: supply of gaseous fuel for 52 points described in detail in Annex 2 to the SWZ. The amount of gas supplied during the contract execution period is: approx. 5 291.17 MWh. b) Gas fuel is intended for heating purposes. In the above-mentioned quantity of gaseous fuel for heating purposes, the estimated amount of gas not subject to exemption from excise duty is 1 002.15 MWh. Detailed information is included in Annex 2 to the specification. The remaining quantity of gaseous fuel shall be exempt from excise duty. General requirements 1. The gaseous fuel supplied must meet the technical standards. in accordance with the provisions of the Energy Law and executive regulations to this Act and Polish Standards. 2. Under before. The Contractor will be responsible for commercial balancing of gas purchased by the Ordering Parties. 3. The determination of the amount of gaseous fuel is an element necessary to select the most advantageous offer and does not constitute an obligation on the part of the Ordering Parties to purchase gaseous fuel in the given quantities. 4. The amount of the expected amount of gaseous fuel intake was determined on the basis of the estimated costs of purchasing electricity that the contracting authority intends to purchase within 12 months following the first delivery 5. After signing the contract, Move. Progress. will provide the necessary data to carry out. procedures for changing the seller in the electronic version of EXCEL. 6. The Contractor shall perform all activities and arrangements with the DSO (Polska Spółka Gazownictwa S.A.) necessary to carry out. procedures for changing the seller and effective commencement of the sale of gaseous fuel, including in particular: termination of existing comprehensive agreements, notification of new gaseous fuel sales agreements to the DSO. Part 2

a) The scope of the contract includes: supply of gaseous fuel for 15 points described in detail in Annex 3 to the SWZ. The amount of gas supplied during the contract execution period is: approx. 2 240.00 MWh.

b) Gaseous fuel is intended for heating purposes and is not exempt from excise duty in its entirety.

General requirements

1. The supplied gaseous fuel must meet technical standards in accordance with the provisions of the Energy Law and its executive regulations and Polish Standards.

2. As part of the subject of the contract, the Contractor shall be responsible for commercial balancing of gaseous fuel purchased by the Contracting Authorities.

3. The determination of the amount of gaseous fuel is an element necessary to select the most advantageous offer and does not constitute an obligation on the part of the Ordering Parties to purchase gaseous fuel in the given quantities.

4. The amount of the expected gaseous fuel consumption has been determined on the basis of consumption from the previous 12 months, taking into account the expected changes in the quantity of gaseous fuel ordered during the term of the future contract.

5. After signing the contract, the Investigator will provide the necessary data to carry out the procedure of changing the seller in the EXCEL electronic version.

6. The Contractor shall perform all actions and arrangements with the DSO (Polska Spółka Gazownictwa S.A.) necessary to carry out the procedure of changing the seller and effectively start selling gaseous fuel, including in particular: termination of existing comprehensive agreements, notification of new gas sales agreements to the DSO. These activities shall be performed by the Contractor on the basis of relevant powers of attorney granted by the Contracting Parties together with the conclusion of contracts for the sale of gaseous fuel.

7. For all collection points it will be another change of seller. The current gas supplier is PGNiG Obrót Detaliczny sp. z o. o.

8. The sale of gaseous fuel will take place on the basis of agreements concluded separately by individual educational institutions, organizational units and companies in the Municipality of Żory described in detail in Annexes No. 2 and No. 3 to the SWZ.
